On August 22, 2025 the IDS Commission approved changes to the Rules and to the billing and expense polices for non-capital criminal and non-criminal case types.
These changes apply to cases that are charged on or after January 1, 2026.
The new rules and policy updates apply to all non-capital criminal and all non-criminal case types at the trial level.
These (do) include:
- Adult criminal cases
- Juvenile cases, and
- Parent Representation Cases
- Abuse/Neglect/Dependency, Termination of Parental Rights, Competency, Civil Commitment, and Child Support Contempt, the appointed attorney or Guardian ad Litem
Note: Part 1 Rules address the procedure for appointing and compensating counsel in all cases subject to the oversight of the Office of Indigent Defense Services (IDS Office), except for:
- Capital cases, which are covered by Part 2 of these rules
- Appellate cases, which are covered by Part 3 of these rules, and
- Cases in which the State is obligated to provide legal assistance and access to the courts to inmates in custody of the Department of Correction, which are covered by Part 4 of these rules
