DESCRIPTION:The Death Penalty 2025 Seminar will be in Chapel Hill May 1-2\, 2025.\nAGENDA\nNCAJ is sponsoring the seminar. The seminar has two parts. \nThe first is Thursday evening\, May 1\, 2025. There will be a reception\, a banquet\, and a guest speaker. \nThe reception begins at 5 p.m. \nThe guest speaker is Professor Seth Kotch. Professor Kotch teaches American Studies at UNC. He is the author of the book “Lethel State – A history of the Death Penalty in North Carolina” (2019). Kotch traces the death penalty from the Reconstruction Act of 1867 to the present. He walks us through hanging\, the electric chair\, the gas chamber\, and the gurney. He discusses the cases of Furman v. Georgia\, and Woodson v. NC. This is a history lesson we all need to hear. DESCRIPTION:The Mecklenburg County Public Defender’s Office is hosting a free to attend presentation on DWI Knoll Motions. If attending in person\, you are welcome to bring your lunch. \nWhat:  The North Carolina Supreme Court’s opinion in State v. Knoll ordered the dismissal of driving while impaired charges for three defendants\, finding that a substantial statutory violation in setting pretrial release conditions irreparably prejudiced each defendant. Knoll and its progeny create unique avenues to seek dismissal of impaired driving charges. This session will discuss several common and uncommon statutory violations and how to establish the elusive “prejudice” that Knoll requires. This session will also discuss the difference between statutory and constitutional violations in setting conditions of release. \nThe Pre-Trial Integrity Act\, N.C.G.S. §15A-533\, requires that a judge rather than a magistrate set conditions of release in certain circumstances. This new law can result in someone charged with DWI held without bond\, which may provide grounds for a motion to dismiss under Hill and Knoll. This session will discuss these opportunities. \nWho: David Eil has been an Assistant Public Defender in Mecklenburg County since 2021. \nKathryn McEvoy graduated from the University of Virginia School of Law in 2023. In Virginia\, she practiced as a student attorney with the Charlottesville Public Defender in both adult and juvenile defense. You will receive an email on May 29th with log-on information. \nWhat: Criminal defense attorneys and others on the defense team sometimes face clients in a mental health crisis or have those close to their clients reach out about the client in crisis. This presentation provides an overview of the crisis response services available in Mecklenburg County through our agency\, Affiliated Sante Group – CriSyS. (Note: For attendees in other counties\, there are similar services available through local providers in all counties of NC) It will highlight the resources and support systems in place for individuals experiencing mental health crises. The goal is to inform and equip others with the knowledge needed to effectively navigate crisis situations and connect individuals to appropriate services. It will also include de-escalation techniques\, recognizing signs of mental distress and how to effectively communicate with others when a criminal defense attorney interacts with someone in crisis. \nWho: Rebecca Peacock holds a graduate degree in Clinical Social Work from Columbia University in New York City\, and a bachelor’s in social work from Western Michigan University. She has held a clinical social work license (LCSW) since 2021. Rebecca has spent her social work career focusing on crisis intervention\, starting as a mobile crisis clinician out of grad school as her first position. \nRebecca has worked across the crisis continuum of care\, including mobile crisis and co responder teams\, in the hospital system and working for 988 call centers. She has been in both direct care and leadership roles and feels passionate about suicide prevention and working with those that struggle with severe and persistent mental health issues. \nRebecca joined Sante working for CriSyS in North Carolina in the summer of 2022 as a Community Policing Crisis Response Team (CPCRT) Clinician. She was moved into the role as Mobile Crisis Team (MCT) Clinical Coordinator in 2023 and took the position as the Director of CriSyS in 2025. \nPlease email Anthony.F.Monaghan@nccourts.org with any questions.
