DESCRIPTION:Registration for the 2024 Misdemeanor Defender Training\, co-sponsored by the School of Government and the Office of Indigent Defense Services\, is now available at https://www.sog.unc.edu/courses/misdemeanor-defender-training. \nAgenda – 2024 Misdemeanor Defender Training\nProgram: This course is an introductory program for attorneys new to misdemeanor cases. Sessions focus on stops and searches\, impaired driving\, ethical issues in district court\, sentencing and jail credit\, probation violations\, and other matters in misdemeanor cases. The program also provides instruction on client interviewing\, negotiation\, and trial skills\, including a small group workshop on trial skills. \n  \nParticipants: This training is for public defenders\, private assigned and managed assigned counsel who perform a significant amount of appointed work in district court. \n  \nLocation\, Dates\, and Times: The agenda can be found on the course page. Thanks to the support of the Office of Indigent Defense Services and the UNC School of Government\, we are pleased to announce that there is no registration fee for indigent defenders who meet the eligibility criteria described below. \nThe 2024 Winter Criminal Law Update will cover recent criminal law decisions issued by the North Carolina appellate courts and highlight significant criminal law legislation enacted by the North Carolina General Assembly. School of Government faculty Phil Dixon\, Joe Hyde\, and Daniel Spiegel will discuss a wide range of issues affecting felony and misdemeanor cases in the North Carolina state courts. You may log on or enter the 4th floor conference room of the Mecklenburg County Public Defender’s Office by 11:45am. \nWhere: Anyplace you have internet or the 4th floor conference room (720 E 4th St Charlotte; take the elevator to the 4th floor and the conference room is on your left.) \nWhat:  This one-hour presentation will be divided into four sections: \n\nA brief overview of Incapacity to Proceed (ITP) including a review of the Dusky Standard and how it applied and assessed in North Carolina at the local level and at the state hospital.\nThe fundamentals of capacity restoration will be discussed with a focus on the areas of: psychiatric stability\, knowledge of legal system and individual circumstance\, and development of problem-solving abilities\nReview of the legal and clinical criteria for the three types of capacity restoration programs currently available for Mecklenburg County defendants: Inpatient at Broughton State Psychiatric Hospital\, Detention-based through NC-RISE\, and Outpatient at Atrium Health’s CCRP\nInstruction in court referral process to the various capacity restoration programs with a focus streamlining the assessment/admission process\, reducing delays and the scheduling of unnecessary court hearings\, and allowing defendants to be served in the most appropriate/least restrictive setting.\n\nWho:  \nDr. Anna Abate is a licensed clinical psychologist with specialized expertise in forensic psychology. She earned her Ph.D. from Sam Houston State University\, completing her training through internship at the University of North Carolina and fellowship at the Institute of Law\, Psychiatry\, & Public Policy at the University of Virginia. Her background includes managing research initiatives\, conducting forensic evaluations\, and guiding program evaluation and policy development. Previously\, Dr. Abate served as the Assistant Director of Research at North Carolina State University’s Center for Family and Community Engagement\, where she supported various research and evaluation efforts. Simultaneously\, she managed a private practice\, providing forensic evaluations and mental health assessments for a variety of psycho-legal questions. Currently\, Dr. Abate serves as Program Administrator for the NC RISE program\, where she plays a critical role in overseeing and developing this jail-based capacity restoration program. \n  \nDr. Sherif Soliman is the medical director for the Atrium Health Community Capacity Restoration Program and the Program Director for the Forensic Psychiatry Fellowship Training Program. He is board certified in General\, Forensic\, and Geriatric Psychiatry and is a Clinical Associate Professor at the Wake Forest of Medicine and Atrium Health. In addition\, he holds an academic appointment at Case Western Reserve School of Medicine in Cleveland\, Ohio. He completed medical school (2000)\, psychiatry residency (2004)\, and geriatric psychiatry fellowship (2005) at Wayne State University in Detroit and has completed Forensic Psychiatry fellowship training at Case Western (2006). \nAfter graduating fellowship in 2006\, Dr. Soliman served as an attending psychiatrist at Northcoast Behavioral Healthcare and as the Associate Forensic Director of the former Cleveland Campus of Northcoast. Dr. Soliman’s duties included treating and evaluating forensic and civil patients\, completing forensic reports such as risk assessments and competence to stand trial evaluations\, and designing policies for the treatment and assessment of forensic patients. Dr. Soliman was also forensic psychiatrist at the Cuyahoga County Court Clinic and the City of Cleveland Municipal Court Psychiatric Clinic. Dr. Soliman’s duties included completing forensic reports such as sanity at the time of the act evaluations\, mitigation of penalty evaluations\, and competence to stand trial evaluations\, among others. He served as a CIT trainer for the Cleveland Police Department. \nDr. Soliman moved to Charlotte\, North Carolina in 2018 to join Atrium Health\, where he works as a forensic psychiatrist and an emergency department psychiatrist. In addition\, he does forensic psychiatric evaluations at Broughton Hospital. Dr. Soliman servs as chair of the Geriatric Psychiatry and the Law Committee at the American Academy of Psychiatry and the Law\, is a past president of the Midwest Chapter of the American Academy of Psychiatry and the Law and has been awarded the Award for Best Teacher in a Forensic Fellowship by the American Academy of Psychiatry and the Law. This award is awarded for excellence in teaching forensic psychiatry fellows. Dr. Soliman is active in teaching medical students\, residents\, and fellows. In addition to teaching residents at Atrium Health\, he teaches forensic psychiatry fellows at Case Western Reserve\, residents at Mountain Area Health Education Center (MAHEC)\, and been an invited speaker at other residency programs throughout the country. He has also lectured at Continuing Legal Education conferences and to adult protective services workers. \n  \nStephen Strzelecki\, Psy.D. is a forensic and clinical neuropsychologist who has been licensed in North Carolina since 1995. He has worked in various settings\, including inpatient pediatric rehabilitation\, community mental health\, and private practice\, which also included contractual forensic evaluations through the local mental health Managed Care Organization (MCO) and the NC Department of Juvenile Justice. \nSince 2013\, Dr. Strzelecki has been part of Mecklenburg County’s Criminal Justice Services (CJS)\, where he serves as the Clinical Director of the Forensic Evaluations Unit (FEU).  In this role he oversees the completion of Mecklenburg County court-ordered forensic psychological evaluations from all levels of the judiciary\, as well as behavioral health diversion programs and grant-based projects designed to address the needs of justice involved individuals with severe mental health disorders\, substance use issues\, and intellectual-developmental disabilities. \nProjects in which Dr. Strzelecki is involved include; Understanding the Frequent Utilizer Population research project with Policy Research Associates\, SOAR-Criminal Justice grant project through SAMHSA to expedite access to disability benefits for individuals that are experiencing homelessness and involved with the criminal justice system\, and SAMHSA’s GAINS Center-Learning Collaborative: Competence to Stand Trial/Competence Restoration project with the North Carolina Department of Health and Human Services. \nWithin Mecklenburg County\, Dr. Strzelecki serves as the chair for the Stepping Up Committee\, which is part of a state and national initiative that focuses on reducing the number of individuals with mental illness in jails. He is also a member the Substance Use Disorder Task Force Leadership team\, the Involuntary Commitment Committee\, Juvenile Model Court Committee\, and an instructor with the Mecklenburg County CIT program. \n  \nYolanda Tindal is the program manager for the Atrium Health Community Capacity Restoration Program. As a licensed clinician\, she has over 15 years of experience working closely with populations interacting with mental health services in conjunction with the criminal justice system. Yolanda is currently designing\, implementing and managing a grant funded pilot program provided by the Department of Health and Human Services. Please note there is no online option for this seminar. \nWhat: This presentation will provide an overview of probabilistic genotyping (PG) software\, now being used to interpret complex DNA mixtures at the Charlotte Mecklenburg Police Department Lab (as well as the NC State Crime Lab).  Attendees will learn more about the functionality of the PG software (STRmix) and become familiar with report structure and conclusions.  The objective of the presentation is to gain a better understanding of how the software is implemented and used to interpret complex DNA mixtures.  Attendees will become more informed about what to expect from the lab (reports\, underlying result\, software output files)\, the limitations of the software\, and venues for challenging PG results in defense of their criminal clients. \nWho: Dr. Maher “Max” Noureddine\, PhD. is a molecular geneticist with extensive background in scientific research in human genetics and expertise in Forensic DNA evidence. He earned his Ph.D. in Molecular Genetics from the University of North Carolina at Chapel Hill.  He then completed a postdoctoral fellowship at Duke University Medical Center (The Center for Human Genetics)\, where he published many articles on the genetics of Parkinson Disease and other human genetic disorders.  His expertise includes specialized training in complex genomics\, DNA fingerprinting\, mitochondrial genome analysis\, Single Nucleotide Polymorphism studies\, and state of the art methodologies in gene structure and function studies. Knoll ordered the dismissal of driving while impaired charges for three defendants\, finding that a substantial statutory violation in setting pretrial release conditions irreparably prejudiced each defendant. Knoll and its progeny create unique avenues to seek dismissal of impaired driving charges. This session will discuss several common and uncommon statutory violations and how to establish the elusive “prejudice” that Knoll requires. This session will also discuss the difference between statutory and constitutional violations in setting conditions of release. \nThe Pre-Trial Integrity Act\, N.C.G.S. §15A-533\, requires that a judge rather than a magistrate set conditions of release in certain circumstances. This new law can result in someone charged with DWI held without bond\, which may provide grounds for a motion to dismiss under Hill and Knoll. This session will discuss these opportunities. \nWho: David Eil has been an Assistant Public Defender in Mecklenburg County since 2021. \nKathryn McEvoy graduated from the University of Virginia School of Law in 2023. You will receive an email on May 29th with log-on information. \nWhat: Criminal defense attorneys and others on the defense team sometimes face clients in a mental health crisis or have those close to their clients reach out about the client in crisis. This presentation provides an overview of the crisis response services available in Mecklenburg County through our agency\, Affiliated Sante Group – CriSyS. (Note: For attendees in other counties\, there are similar services available through local providers in all counties of NC) It will highlight the resources and support systems in place for individuals experiencing mental health crises. The goal is to inform and equip others with the knowledge needed to effectively navigate crisis situations and connect individuals to appropriate services. It will also include de-escalation techniques\, recognizing signs of mental distress and how to effectively communicate with others when a criminal defense attorney interacts with someone in crisis. \nWho: Rebecca Peacock holds a graduate degree in Clinical Social Work from Columbia University in New York City\, and a bachelor’s in social work from Western Michigan University. She has held a clinical social work license (LCSW) since 2021. Rebecca has spent her social work career focusing on crisis intervention\, starting as a mobile crisis clinician out of grad school as her first position. \nRebecca has worked across the crisis continuum of care\, including mobile crisis and co responder teams\, in the hospital system and working for 988 call centers. She has been in both direct care and leadership roles and feels passionate about suicide prevention and working with those that struggle with severe and persistent mental health issues. \nRebecca joined Sante working for CriSyS in North Carolina in the summer of 2022 as a Community Policing Crisis Response Team (CPCRT) Clinician. The webinar includes a visual presentation\, live audio\, and interactive Q & A. \nCLE: 60 minutes of General CLE Credit is pending. \nIndividual Course Sign Up: here \nSeries Sign Up: here \nFee: There is no registration fee for participants. \nDescription: This presentation will cover the tenets of trauma-informed interviewing and will provide the audience with an introduction to the neurobiology of trauma and trauma’s impact on memory. \nTrauma-informed interviewing is both: an understanding of how memory is limited and changed by a traumatic experience\, and an effort to address the ways in which the interview itself can be re-traumatizing.  This presentation will discuss how to incorporate transparency\, trust\, and choice to limit possible re-traumatization and how to protect the emotional and mental wellbeing of the interviewer. \nParticipants: This webinar is open to public defenders\, private attorneys who do indigent criminal defense work\, and their staff. \nPresenter:  Emma Paul is the Victim Services Program Manager for the Innocence Inquiry Commission.  Emma provides direct support and advocacy to victims of crime\, develops and implements trauma-informed policies and practices\, and consults with investigators on best approaches to engaging with victims. \nPrior to joining the Innocence Inquiry Commission Staff in February 2020\, Emma worked as a Project Assistant at the National Center for Child Traumatic Stress. During her time at the National Center for Child Traumatic Stress\, Emma served the researchers\, child psychiatrists\, and community providers working to raise the standard of care and improve access to services for traumatized children\, their families and communities throughout the United States. DESCRIPTION:The Mecklenburg County Public Defender’s Office and the Federal Defender for the Western District of North Carolina are hosting a FREE-to-attend Mitigation for the Non-Capital Client Series\, either in person at the Mecklenburg County Public Defender’s Office or through Webex. \nEach session is 90 minutes (from 12:30-2pm) and is approved for 1.5 hours of other CLE credit.  If you need CLE credit\, you must sign in if attending in person or if attending online\, you either need to complete the post-CLE survey or email me your name\, NC State Bar # and how long you attended by the Wednesday after the presentation. \n  \nThe series will offer tips and suggestions to answer the below questions: \n\n\n\n\n\nHow did our client get in this position with the charges they are facing?
