Mr. Williams received a B.A. in Political Science and J.D. from Duke University. He was Chief Public Defender for Orange and Chatham Counties from 1990-2017 and previously the Felony Chief of the Mecklenburg County Public Defender’s Office. While a member of the N.C. Advocates for Justice Board of Governors\, Mr. Williams helped establish and served as Chair of the Task Force on Racial and Ethnic Bias in the Criminal Justice System which ultimately led to the establishment of the NC CRED. Mr. Williams is also a founder and Board member of the N.C. Public Defender Committee on Racial Equity and serves on numerous boards\, including the N.C. Fines and Fees Coalition\, National Consortium on Racial and Ethnic Fairness in the Courts\, N.C. Association of Black Lawyers\, Orange Bias Free Policing Coalition. He serves as Co-chair of the District 18 Bar Racial Justice Force. He has received numerous awards\, including the N.C. Advocates for Justice Thurgood Marshall Award\, the MLK University/ Community Planning Inc. MLK Jr. Citizenship Award\, the N.C. ACLU Champion of Justice Award\, and the North Carolina Bar Association James McNeil Smith Jr. Award. \n\n\n\nJeff Kukucka\, Ph.D. Dr. Kukucka is an Associate Professor of Psychology and Law at Towson University in Maryland\, and Vice Chair of the OSAC for Forensic Science\, Human Factors Task Group. His primary line of research examines the causes of\, and solutions for\, cognitive bias in forensic science judgments\, as well as how non-experts understand forensic evidence. He also regularly works as an expert witness on these issues. \n\n\n\nIn 2009\, he graduated summa cum laude and Phi Beta Kappa from Loyola College in Maryland. As an undergrad\, he became involved in research on conformity and eyewitness memory with Dr. Kerri Goodwin (Towson University) and research on child forensic interviewing and metacognition with Dr. Maggie Bruck (Johns Hopkins University). In 2014\, he graduated from the PhD Program in Psychology & Law at the CUNY Graduate Center\, where he worked under Dr. Saul Kassin (John Jay College of Criminal Justice). \n\n\n\nEmily Coward\, J.D. Emily Coward joined the Decarceration Project as Policy Director in December 2021 and will be joining Duke Law as Director of the new Inclusive Juries Project in August 2022. From 2012 to 2021\, she was a member of the UNC School of Government’s Public Defense Education group\, serving as Director and Project Attorney of the NC Racial Equity Network. She received the UNC School of Government Margaret Taylor Writing Award in 2015 for co-authoring Raising Issues of Race in North Carolina Criminal Cases and the James E. Williams award in 2016 from the North Carolina Public Defenders Association. From 2009 to 2011\, she represented clients in civil and post-conviction matters as an attorney with North Carolina Prisoner Legal Services. Ms. Coward served as a law clerk for Judge James Robertson of the United States District Court for the District of Columbia and for Justice Thembile Skweyiya of the Constitutional Court of South Africa. After a brief overview of the concepts of likelihood ratio and probabilistic genotyping\, the program will focus on PG output/results and\, in general terms\, what the software is doing to process a sample. \nThe objective of the program is to provide greater understanding of how software is used to interpret complex mixtures of DNA and help attorneys understand the limitations of the software. Use this link to register for all webinars in the series and attend any that are of interest. \nPresenters:\nDr. Maher “Max” Noureddine\nDr. Maher “Max” Noureddine is molecular geneticist with extensive background in scientific research in human genetics and expertise in DNA forensics. He earned his Ph.D. in Molecular Genetics from the University of North Carolina at Chapel Hill. He then completed a postdoctoral fellowship at Duke University Medical Center (The Center for Human Genetics)\, where he published many articles on the genetics of Parkinson Disease and other human genetic disorders. His expertise includes specialized training in complex genomics\, DNA fingerprinting\, mitochondrial genome analysis\, Single Nucleotide Polymorphism studies\, and state of the art methodologies in gene structure and function studies. \nCurrently\, as a recognized forensic DNA expert and President of the forensics consulting company ForensiGen\, LLC\, Dr. Noureddine provides services and expert consultation to law professionals on DNA and serology evidence in criminal and civil cases\, as well as consulting services to the public in the area of genetic testing. \nElizabeth Daniel Vasquez\nElizabeth Daniel Vasquez is the Director of the Science & Surveillance Project at Brooklyn Defender Services in Brooklyn. In that role\, Elizabeth is responsible for developing BDS’s litigation and advocacy strategy surrounding issues of data\, science\, and technology. She consults on cases involving complex forensic science and surveillance issues\, trains the office in litigating and confronting forensic evidence and emerging surveillance techniques\, spearheads affirmative impact litigation emanating from forensic and surveillance abuses\, and coordinates policy and law reform efforts surrounding emerging forensic science and surveillance concerns. Elizabeth has served as a faculty member for the National Forensic Science College\, an adjunct professor at Cardozo Law School\, and a trainer and panelist at numerous local and national convenings on forensic science and surveillance issues. \nBefore joining BDS\, Elizabeth worked as a staff attorney in the trial division of the Public Defender Service (“PDS”) for the District of Columbia. At PDS\, Elizabeth represented adults and juveniles in D.C. Superior and Family Court who were charged with serious felonies. She also served as a member of PDS’s Forensic Practice Group. Before PDS\, Elizabeth was an associate at Neufeld Scheck & Brustin\, LLP\, litigating wrongful conviction and civil rights cases in state and federal courts throughout the country. At NSB\, Elizabeth’s work focused predominantly on complex § 1983 claims that involved faulty forensic evidence. Elizabeth is a cum laude graduate of New York University School of Law\, where she was Editor-in-Chief of the Review of Law and Social Change and participated in Bryan Stevenson’s Equal Justice and Defender Clinic. She received her B.A. with Honors from the University of Chicago.

DESCRIPTION:Live webinar presented by Attorney Hannah Autry\, and Assistant Public Defender Samantha Grill\, and Pate Skene\, J.D.\, Ph.D.\nMar. 3\, 2022\, 12:30-2 pm\n90 min of CLE credit anticipated  \nDescription:\nIndigent Defense Services and the Mecklenburg County Public Defender’s Office will offer a series of monthly webinars which prepare attorneys to challenge unreliable forensic science evidence in 702/Daubert hearings. The second program in the series will examine challenging whether an expert’s testimony is the product of reliable principles and methods. This discussion will set the stage for a day-long CLE the following day which addresses challenges to firearms evidence. \nIn this program\, Dr. Skene will address what type of scientific research is needed to validate a forensic method. He will discuss study design\, including open vs closed set\, black box studies\, and neutral study administrators. Dr. Skene will also discuss error rates and different types of error including false positive\, false negative\, and inconclusive errors. \nAfter setting out the framework for evaluating whether testimony is the product of reliable principles and method\, the presenters will consider several practical aspects of making a 702 challenge\, including selecting the right kind of expert to question the foundational validity of a discipline and the timing of such a challenge. Hannah Autry and Samantha Grill will present case examples and discuss the pros and cons of having a pre-trial hearing versus making the challenge during trial on voir dire of the state’s expert. \nRegistration:\nThis program is part of the 2022 IDS Forensic Science Education Series. The webinars will be presented monthly and are free to attend. Attorneys who want CLE credit for attending will be billed $3.50 per credit hour by the State Bar. Use this link to register for all webinars in the series and attend any that are of interest. \nPresenters:\nHannah Autry\, J.D.\nHannah is a staff attorney at Center for Death Penalty Litigation (CDPL)\, where she has been working since 2017.  She represents death-sentenced clients in state and federal post-conviction proceedings\, clients charged with first degree murder at the trial level\, and clients facing low level felonies in Durham.  She regularly attends national and North Carolina conferences focused on issues surrounding the death penalty\, death penalty litigation\, forensic sciences\, and race.  She was a member of the 2017-2018 cohort of the Racial Equity Network\, a group of attorneys who aim to promote a more racially equitable justice system. She serves on the board of The Decarceration Project\, a Durham-based nonprofit. Before joining CDPL\, Hannah practiced in the public defender’s office in Frankfort\, Kentucky\, where she represented clients facing charges ranging from misdemeanors to murder.  A native of Cumberland County\, Hannah received her undergraduate degree at The University of North Carolina at Chapel Hill and graduated with honors from North Carolina Central University School of Law in May 2013. \n  \nSamantha Grill\, J.D.\nSamantha Grill is an Assistant Public Defender in the Mecklenburg County Public Defender’s Office.  She received her undergraduate degree from The College of William and Mary and her law degree from Duke University School of Law.  Samantha has been an Assistant Public Defender for about ten years and currently represents individuals facing habitual felon status. \n  \nJ.H. Pate Skene\, Ph.D.\, J.D.\nPate Skene is a neurobiologist and attorney investigating brain mechanisms involved in decision-making related to law\, cooperation\, and risk. Pate’s research focuses on the evolution of brain mechanisms important for social cooperation in humans and other primates\, and application of this research in criminal and civil litigation and regulatory policy. His legal practice focuses on scientific evidence and expert testimony in criminal and civil litigation. His areas of expertise include the cognitive neuroscience of decision-making\, human factors in laboratory procedures\, and the evaluation of scientific and technical evidence by courts and regulatory agencies. Pate’s scientific background includes more than 30 years as director of a laboratory conducting research in molecular genomics\, biochemistry\, and cognitive neuroscience. He currently serves on the Human Factors Task Group and the Forensic Toxicology subcommittee of the Organization of Scientific Advisory Committees on forensic sciences at NIST. Laboratory research interests include the evolutionary genomics and functional imaging of brain mechanisms involved in complex social decision-making and large-scale cooperation in humans. \n
