We’ve all been in a situation when trying to communicate with a challenging or complicated client does not go well and becomes nonproductive. How do we handle it and what’s the best course of action? While the suggested methods aren’t guaranteed\, the goal of this session is to offer some tips for successfully breaking through difficult barriers to effectively communicate with your client\, their family and witnesses for their defense. \nWho: LaTorya Blackwell has more than 20 years of experience working in indigent defense services. She graduated from the University of North Carolina Charlotte with a Bachelor of Arts degree in Criminal Justice and completed the Criminal Investigation Certificate Program (CICP) at the North Carolina Justice Academy. Currently\, she is an investigator with the Federal Public Defenders Office in the Western District of North Carolina since January 2014. As of December 2022\, she was promoted to be the Legal Chief/Chief Investigator within the office.  Before transitioning to the Federal Public Defenders office\, she was an investigator at the Mecklenburg County Public Defender’s Office in Charlotte\, North Carolina for 10 years. Prior to that\, her background includes working closely with the Department of Juvenile Justice and local area Mental Health as a treatment residential counselor for troubled youth. Beginning in 2018\, LaTorya was afforded the opportunity to facilitate the Paralegal and Investigator Skills Workshop sponsored by Defender Services Training Division and most recently served as faculty at the Federal Defender Investigator and Paralegal Seminar and the National Defender Investigator Association conference. The conference room will open by 12:15pm \nWhat: The speakers will discuss the collateral consequences of juvenile adjudications and why taking steps to expunge these adjudications are so important. They will next discuss the process to obtain expunctions of juvenile adjudications as well as certain criminal convictions obtained prior to Raise the Age. \nWho: \nVeronika Monteleone graduated from Carolina Law with honors in 2015. She began her legal career at the Council for Children’s Rights representing children in both civil commitment proceedings and juvenile delinquency matters. She became a board-certified specialist in Juvenile Delinquency Law in 2021 and is a certified Juvenile Training Immersion Program Trainer. She is currently an Assistant Public Defender with the Mecklenburg County Public Defender’s Office. Prior to her current role\, she was an Assistant Public Defender and Juvenile Court Supervisor at the Gaston County Public Defender’s Office. \nCourtney Viebrock manages the Pro Bono Program for the Charlotte Center for Legal Advocacy. In this program\, she engages Charlotte’s legal community in serving the Advocacy Center’s clients by partnering with firms\, in-house attorneys at financial institutions and corporations\, and community organizations. The Pro Bono Program supports each program by sending cases to pro bono attorneys and holding clinics using volunteer attorneys and legal professionals. Before joining the Advocacy Center in March 2023\, Courtney began her legal career administering research and development of federal government contracts with the National Institute of Allergy and Infectious Diseases. After moving to Charlotte\, she transitioned to criminal law\, working for the Mecklenburg County District Attorney’s Office for five years. As an Assistant District Attorney\, she prosecuted misdemeanor and felony cases through all stages in district\, juvenile\, and superior court while gaining valuable bench and jury trial experience. Take elevator to 4th floor and conference room is on left) \nWhat: \nJoin forensic psychologists Dr. Cantley\, Dr. Hart\, and Dr. Klosek Watters for an in-depth discussion of case studies focused on diminished capacity\, mitigation\, and other psycholegal evaluation questions. Discussion will cover the intersection of law and psychology\, how experts approach these legal referral questions\, and finding the best fit for the final work product. \nWho: \nDr. Cantley\, Dr. Hart\, and Dr. Watters Klosek have over 50 cumulative years of experience conducting forensic psychological evaluations.  They have joined forces to create Forensic Minds Consulting.  Forensic Minds Consulting uses a team approach to ensure that their psychological evaluations are conducted with the exacting level of integrity\, diagnostic accuracy\, and objectivity that is critical to high quality forensic evaluations. All experts at Forensic Minds Consulting are licensed\, doctoral level psychologists\, who bring a wealth of experience and specialized forensic training to their work. The team approach allows cases to be informed by the group’s broad collective expert knowledge base. Two experts work together to complete each evaluation\, one of which is identified as the lead psychologist\, who will be the primary point of contact. She gained experience in various settings in California and North Carolina including a private psychiatric hospital\, a psychiatric residential facility\, a federal correctional center\, a juvenile youth development center\, and in Mecklenburg County government before she established a successful private practice specializing in forensic\, clinical\, and neuropsychological evaluations. She is now dedicated to providing consultation and evaluations in the context of criminal forensic psychology. \nDr. Virgina Hart is a highly qualified forensic expert with over 20 years of experience in forensic and clinical psychology. She obtained a PhD in Clinical Psychology with a subspecialty in Psychology and Law from the University of Alabama. Dr. Hart’s extensive forensic training includes a Forensic Psychology predoctoral internship via the Federal Bureau of Prisons and a Forensic Psychology postdoctoral fellowship through the University of Virginia Institute of Law\, Psychology and Public Policy. She has a broad range of experience working in various clinical settings\, including correctional facilities\, state hospitals\, forensic state hospitals\, inpatient units\, and outpatient settings. DESCRIPTION:Registration is open for the 2024 North Carolina Appellate Advocacy Training\, sponsored by the School of Government and the Office of Indigent Defense Services. \nAgenda\nGuide for Participants\n  \nPARTICIPANTS: The Appellate Advocacy Training is open to assistant appellate defenders and attorneys on the appellate appointment list maintained by the Office of the Appellate Defender. Eligibility questions should be directed to Glenn Gerding at (919) 354-7210 or glenn.g.gerding@nccourts.org. \n  \nREQUIREMENTS: To prepare for the program\, please read the Guide for Participants\, which is attached and is also posted on the course webpage under the “Materials” tab. \nAt the end of the guide\, there is a form to fill out summarizing the non-capital case you will work on at the program. DESCRIPTION:Registration is now OPEN for the 2024 Bridging the Gap VIII Mitigation Conference. \nPreparing a capital case for trial is difficult. You know the state’s case. You have figured out some sort of defense. You must plan for a sentence hearing. All the planning is directed towards convincing one or more jurors to vote for life even though they believe in the death penalty. This conference focuses on the moment in time of the killing. That will be on the minds of the jurors. Somehow\, we must give the jurors reasons for life\, which is called mitigation. But the presentation of mitigation must break through the hard crust of a belief in the death penalty\, a belief that you are responsible for your actions\, an eye for an eye. Just telling the jury about your client’s mental problems and childhood problems will not break the crust. We must show how those issues and life problems affected the client’s decision to be at the scene and deciding to kill someone. We will use the fictitious case of State v. Thomas Johnson. We will try to figure out why Thomas was in the parking lot trying to rob someone and why he shot and killed the victim. From there we gather and review all his records and history looking for clues to the why. We have gathered an amazing group of speakers who will explain how to recognize issues and problems the client has and explain how those issues and problems affected the moment in time when Thomas killed someone. She earned her Ph.D. from Sam Houston State University\, completing her training through internship at the University of North Carolina and fellowship at the Institute of Law\, Psychiatry\, & Public Policy at the University of Virginia. Her background includes managing research initiatives\, conducting forensic evaluations\, and guiding program evaluation and policy development. Previously\, Dr. Abate served as the Assistant Director of Research at North Carolina State University’s Center for Family and Community Engagement\, where she supported various research and evaluation efforts. Simultaneously\, she managed a private practice\, providing forensic evaluations and mental health assessments for a variety of psycho-legal questions. Currently\, Dr. Abate serves as Program Administrator for the NC RISE program\, where she plays a critical role in overseeing and developing this jail-based capacity restoration program. \n  \nDr. Sherif Soliman is the medical director for the Atrium Health Community Capacity Restoration Program and the Program Director for the Forensic Psychiatry Fellowship Training Program. He is board certified in General\, Forensic\, and Geriatric Psychiatry and is a Clinical Associate Professor at the Wake Forest of Medicine and Atrium Health. In addition\, he holds an academic appointment at Case Western Reserve School of Medicine in Cleveland\, Ohio. He completed medical school (2000)\, psychiatry residency (2004)\, and geriatric psychiatry fellowship (2005) at Wayne State University in Detroit and has completed Forensic Psychiatry fellowship training at Case Western (2006). \nAfter graduating fellowship in 2006\, Dr. Soliman served as an attending psychiatrist at Northcoast Behavioral Healthcare and as the Associate Forensic Director of the former Cleveland Campus of Northcoast. Dr. Soliman’s duties included treating and evaluating forensic and civil patients\, completing forensic reports such as risk assessments and competence to stand trial evaluations\, and designing policies for the treatment and assessment of forensic patients. Dr. Soliman was also forensic psychiatrist at the Cuyahoga County Court Clinic and the City of Cleveland Municipal Court Psychiatric Clinic. Dr. Soliman’s duties included completing forensic reports such as sanity at the time of the act evaluations\, mitigation of penalty evaluations\, and competence to stand trial evaluations\, among others. He served as a CIT trainer for the Cleveland Police Department. \nDr. Soliman moved to Charlotte\, North Carolina in 2018 to join Atrium Health\, where he works as a forensic psychiatrist and an emergency department psychiatrist. In addition\, he does forensic psychiatric evaluations at Broughton Hospital. Dr. Soliman servs as chair of the Geriatric Psychiatry and the Law Committee at the American Academy of Psychiatry and the Law\, is a past president of the Midwest Chapter of the American Academy of Psychiatry and the Law and has been awarded the Award for Best Teacher in a Forensic Fellowship by the American Academy of Psychiatry and the Law. This award is awarded for excellence in teaching forensic psychiatry fellows. Dr. Soliman is active in teaching medical students\, residents\, and fellows. In addition to teaching residents at Atrium Health\, he teaches forensic psychiatry fellows at Case Western Reserve\, residents at Mountain Area Health Education Center (MAHEC)\, and been an invited speaker at other residency programs throughout the country. He has also lectured at Continuing Legal Education conferences and to adult protective services workers. \n  \nStephen Strzelecki\, Psy.D. is a forensic and clinical neuropsychologist who has been licensed in North Carolina since 1995. He has worked in various settings\, including inpatient pediatric rehabilitation\, community mental health\, and private practice\, which also included contractual forensic evaluations through the local mental health Managed Care Organization (MCO) and the NC Department of Juvenile Justice. \nSince 2013\, Dr. Strzelecki has been part of Mecklenburg County’s Criminal Justice Services (CJS)\, where he serves as the Clinical Director of the Forensic Evaluations Unit (FEU).  In this role he oversees the completion of Mecklenburg County court-ordered forensic psychological evaluations from all levels of the judiciary\, as well as behavioral health diversion programs and grant-based projects designed to address the needs of justice involved individuals with severe mental health disorders\, substance use issues\, and intellectual-developmental disabilities. \nProjects in which Dr. Strzelecki is involved include; Understanding the Frequent Utilizer Population research project with Policy Research Associates\, SOAR-Criminal Justice grant project through SAMHSA to expedite access to disability benefits for individuals that are experiencing homelessness and involved with the criminal justice system\, and SAMHSA’s GAINS Center-Learning Collaborative: Competence to Stand Trial/Competence Restoration project with the North Carolina Department of Health and Human Services. \nWithin Mecklenburg County\, Dr. Strzelecki serves as the chair for the Stepping Up Committee\, which is part of a state and national initiative that focuses on reducing the number of individuals with mental illness in jails. He is also a member the Substance Use Disorder Task Force Leadership team\, the Involuntary Commitment Committee\, Juvenile Model Court Committee\, and an instructor with the Mecklenburg County CIT program. \n  \nYolanda Tindal is the program manager for the Atrium Health Community Capacity Restoration Program. As a licensed clinician\, she has over 15 years of experience working closely with populations interacting with mental health services in conjunction with the criminal justice system. Yolanda is currently designing\, implementing and managing a grant funded pilot program provided by the Department of Health and Human Services. Thanks to the support of the Office of Indigent Defense Services and the UNC School of Government\, we are pleased to announce that there is no registration fee for indigent defenders who meet the eligibility criteria described below. \nSchool of Government faculty member Phil Dixon\, Jr. will discuss state and federal appellate court decisions and other recent criminal law developments. \nParticipants: This webinar is open to public defenders\, private attorneys who do indigent criminal defense work\, and any others who are interested in criminal law. \nSchedule: The webinar will be held on Friday\, February 21\, 2025\, from 1:30 p.m. until 3:00 p.m. Please plan to sign on 15 minutes before the start of the webinar to test your connection. \nRegistration: Visit https://www.sog.unc.edu/courses/criminal-law-webinars-case-and-legislative-updates to register online and find additional information about the webinar. A fictional set of facts describes a murder and describes the life of the person charged with the crime. \nThe third session reviews the case study facts and selects the good facts you want to tell the jury and selects the bad facts you want the jury to know about. \nThe fourth session is a demonstration of questioning a potential juror who you want to keep on your jury. \nThe fifth session is a demonstration of questioning a potential juror who you do not want to keep on your jury. \nThe last two sessions allow the participants to practice jury selection using the Wymore method\, with critique. \n  \n5 hours CLE credit is pending approval. If you want CLE credit the State Bar will bill you for the CLE. \n  \nNOTE: This is a free seminar. SUMMARY:2025 Intensive Parent Defender Training
DESCRIPTION:The 2025 Intensive Parent Defender Training\, co-sponsored by the School of Government and the North Carolina Office of Indigent Defense Services\, will be held Thursday\, March 6 through Friday\, March 7. \nPROGRAM OVERVIEW: This training will focus on termination of parental rights (TPR) proceedings and the role of parent defenders. Topics will include a review of the different stages of a TPR; advocacy tips regarding the grounds and the best interest factors; evidentiary considerations at each stage; and more about the steps defenders should take before\, during\, and after a TPR to protect their client’s interests. \nPARTICIPANTS: This program is open to public defenders and private attorneys appointed to represent parents in juvenile abuse\, neglect\, and dependency\, who are interested in the fundamentals of parent representation and in sharpening their advocacy skills. \nLOCATION\, DATES\, & TIMES: This training will be held at the School of Government on the campus of UNC-Chapel Hill on March 6-7. Check-in will start at 8:00 a.m. on Thursday\, March 6. DESCRIPTION:Indigent Defense Services\, the Duke Law Center for Criminal Justice and Professional Responsibility\, the Wilson Center for Science and Justice\, and Pfeiffer Rudolf are pleased to announce the eleventh annual CLE\, “Whiskey in the Courtroom: Evolving Trends in Forensic Science.” Whiskey 11 will take place on March 7\, 2025 at Duke Law School. \nForensic science experts and attorneys who have litigated cases involving complex scientific evidence will present on a range of topics to help attorneys understand the latest trends in forensic evidence\, limitations to this evidence\, and legal challenges that can be made. This year the program will have a special focus on Digital Footprints – What We Leave Behind. \nThe program is open to NC criminal defense and parent attorneys and their staff\, investigators\, mitigation specialists\, and other defense team members. \nThere will be a minimal fee for this program to cover the cost of food and parking. \nA special thank you this year to Pfeiffer Rudolf for helping sponsor the program. DESCRIPTION:The Mecklenburg County Public Defender’s Office is offering a free to attend presentation on Probabilistic Genotyping: Interpreting Complex DNA Mixtures with STRmix. As this presentation will not give a refresher course on DNA basics\, please click the below links (thank you Sarah Olson) for a refresher on the basics of DNA comparison\, so you are prepared for the presentation. Please note there is no online option for this seminar. \nWhat: This presentation will provide an overview of probabilistic genotyping (PG) software\, now being used to interpret complex DNA mixtures at the Charlotte Mecklenburg Police Department Lab (as well as the NC State Crime Lab).  Attendees will learn more about the functionality of the PG software (STRmix) and become familiar with report structure and conclusions.  The objective of the presentation is to gain a better understanding of how the software is implemented and used to interpret complex DNA mixtures.  Attendees will become more informed about what to expect from the lab (reports\, underlying result\, software output files)\, the limitations of the software\, and venues for challenging PG results in defense of their criminal clients. \nWho: Dr. Maher “Max” Noureddine\, PhD. is a molecular geneticist with extensive background in scientific research in human genetics and expertise in Forensic DNA evidence. He earned his Ph.D. in Molecular Genetics from the University of North Carolina at Chapel Hill.  He then completed a postdoctoral fellowship at Duke University Medical Center (The Center for Human Genetics)\, where he published many articles on the genetics of Parkinson Disease and other human genetic disorders.  His expertise includes specialized training in complex genomics\, DNA fingerprinting\, mitochondrial genome analysis\, Single Nucleotide Polymorphism studies\, and state of the art methodologies in gene structure and function studies.
