SUMMARY:LC/MS and its Application in Forensic Toxicology
DESCRIPTION:The Mecklenburg County Public Defender’s Office is hosting a free to attend presentation on LC/MS and its Application in Forensic Toxicology. This presentation is approved for 1 general CLE hour by the NC State Bar. You may log in or enter the conference room by 12:15. \nWhere: Anyplace you have internet or the 4th Floor conference room of the Mecklenburg County Public Defender’s Office [to left off elevator at 720 E 4th St Charlotte]. \n Everyone who registers will receive a link to join the day before. \nWhat: LC/MS is the gold standard in forensic toxicology and the detection of elicit substances. Unlike other forms of analytical testing\, LC/MS relies on the principles of chromatography and mass spectrometry coupled together to determine substances. This presentation dives into this testing method and how it offers undeniable detection of substances and can help attorneys understand why it is needed. Additionally\, I will provide a connection between how forensic chemistry can be used to ultimately understand the pharmacological and toxicology of elicit substances and their impacts to the human body. These pieces of evidence can be critical for attorneys and defense attorneys in truly understanding their clients situations. \nWho: Dr. Rohan Parekh is a chemist by training with a plethora of experience dealing with analytical instruments and techniques such as chromatography and mass spectrometry. He has over 5 years of experience working in industry with these analytical techniques as well as a masters in Chemistry from East Carolina University. Dr. Parekh has also completed a PhD in Pharmacology and Toxicology from the Brody School of Medicine which has provided a strong understanding of drug metabolism and pharmacokinetics and pharmacodynamics\, which aids in his ability to serve as an expert. Dr. Parekh has been published in numerous journals including Nature\, and has taught numerous seminars and courses on drug chemistry\, pharmacology and toxicology. These activities validate Dr. Parekh has developed a keen understanding of translational medicine and how drugs/toxicants and their basic chemical reactions can result in direct effects in humans and can alter their states of consciousness and ensuing actions. \nFor those that may have toxicology evidence in their criminal case\, Dr. Parekh is willing to give a free mini-consult on April 26th so you can decide whether you would like to retain him for your case. SUMMARY:2024 Higher-Level Felony Defense Training
DESCRIPTION:Registration is OPEN! \nWe are pleased to announce that the 2024 Higher-Level Felony Defense training\, cosponsored by the School of Government and the Office of Indigent Defense Services\, will take place on Tuesday\, September 10 through Thursday\, September 12\, 2024\, at the School of Government. \nPARTICIPANTS: This program is for attorneys interested in handling higher-level felony cases at the trial level. Topics will include preparing for serious felony cases\, eyewitness identifications\, habitual felons\, self-defense\, client relations and rapport\, sentencing law and advocacy\, and mitigation investigation. The program consists of a mix of lectures and intensive small-group workshops. Due to the program’s interactive nature\, participants must attend all sessions. \nAGENDA AND REGISTRATION: The agenda will be posted soon on the course page. To register\, visit the course page at https://www.sog.unc.edu/courses/higher-level-felony-defense. The course registration deadline is Friday\, August 30\, at 5:00pm\, but seats may fill quickly\, and capacity is limited\, so do not wait to apply! \nThe Office of Indigent Defense Services has agreed to fund registration for all participants\, including private assigned and managed assigned counsel (although they remain responsible for the cost of their travel\, lodging\, and meals other than lunches and snacks provided during the training). \nDue to the expected level of interest\, the intensive nature of the training\, and limits on seating capacity\, the program is capped at a total of 34 participants. We may not know what to say when someone expresses a threat; it is devastating when we lose someone by suicide and replay in our minds the threats\, both direct and indirect\, that she/he made prior to ending her/his life. Yet\, we are only responsible to do what we know to do at the time it needs doing\, not for the things that we learn to do later. \nQPR was created to be a universal intervention for anyone experiencing emotional distress. While the suggested methods aren’t guaranteed\, the goal of this session is to offer some tips for successfully breaking through difficult barriers to effectively communicate with your client\, their family and witnesses for their defense. \nWho: LaTorya Blackwell has more than 20 years of experience working in indigent defense services. She graduated from the University of North Carolina Charlotte with a Bachelor of Arts degree in Criminal Justice and completed the Criminal Investigation Certificate Program (CICP) at the North Carolina Justice Academy. Currently\, she is an investigator with the Federal Public Defenders Office in the Western District of North Carolina since January 2014. As of December 2022\, she was promoted to be the Legal Chief/Chief Investigator within the office.  Before transitioning to the Federal Public Defenders office\, she was an investigator at the Mecklenburg County Public Defender’s Office in Charlotte\, North Carolina for 10 years. They will next discuss the process to obtain expunctions of juvenile adjudications as well as certain criminal convictions obtained prior to Raise the Age. \nWho: \nVeronika Monteleone graduated from Carolina Law with honors in 2015. She began her legal career at the Council for Children’s Rights representing children in both civil commitment proceedings and juvenile delinquency matters. She became a board-certified specialist in Juvenile Delinquency Law in 2021 and is a certified Juvenile Training Immersion Program Trainer. She is currently an Assistant Public Defender with the Mecklenburg County Public Defender’s Office. Prior to her current role\, she was an Assistant Public Defender and Juvenile Court Supervisor at the Gaston County Public Defender’s Office. \nCourtney Viebrock manages the Pro Bono Program for the Charlotte Center for Legal Advocacy. In this program\, she engages Charlotte’s legal community in serving the Advocacy Center’s clients by partnering with firms\, in-house attorneys at financial institutions and corporations\, and community organizations. The Pro Bono Program supports each program by sending cases to pro bono attorneys and holding clinics using volunteer attorneys and legal professionals. Before joining the Advocacy Center in March 2023\, Courtney began her legal career administering research and development of federal government contracts with the National Institute of Allergy and Infectious Diseases. After moving to Charlotte\, she transitioned to criminal law\, working for the Mecklenburg County District Attorney’s Office for five years. As an Assistant District Attorney\, she prosecuted misdemeanor and felony cases through all stages in district\, juvenile\, and superior court while gaining valuable bench and jury trial experience. She is now dedicated to providing consultation and evaluations in the context of criminal forensic psychology. \nDr. Virgina Hart is a highly qualified forensic expert with over 20 years of experience in forensic and clinical psychology. She obtained a PhD in Clinical Psychology with a subspecialty in Psychology and Law from the University of Alabama. This virtual presentation will explore how to recognize warning signs but most importantly share practical approaches to manage stress and increase and sustain wellbeing. \nWho: Kimberly (Kim) Tran\, PhD\, HSP-P is an Adjunct Professor of Mental Health and the Law in the Military and Veterans Law Clinic at the University of North Carolina School of Law. She is also an Associate Professor in the Department of Psychology at Fayetteville State University. Additionally\, Kim is a licensed psychologist with a private practice in the community. Her research\, teaching\, consultation and clinical practice areas are framed by a multicultural and affirmative lens focused on trauma\, PTSD\, anxiety\, depression\, suicide\, substance use disorders\, chronic pain management\, stress resilience and mind-body-spirit wellness. SUMMARY:Bridging the Gap VIII Mitigation Conference 2024
DESCRIPTION:Registration is now OPEN for the 2024 Bridging the Gap VIII Mitigation Conference. \nPreparing a capital case for trial is difficult. You know the state’s case. You have figured out some sort of defense. You must plan for a sentence hearing. All the planning is directed towards convincing one or more jurors to vote for life even though they believe in the death penalty. This conference focuses on the moment in time of the killing. That will be on the minds of the jurors. Somehow\, we must give the jurors reasons for life\, which is called mitigation. But the presentation of mitigation must break through the hard crust of a belief in the death penalty\, a belief that you are responsible for your actions\, an eye for an eye. Just telling the jury about your client’s mental problems and childhood problems will not break the crust. We must show how those issues and life problems affected the client’s decision to be at the scene and deciding to kill someone. We will use the fictitious case of State v. Thomas Johnson. We will try to figure out why Thomas was in the parking lot trying to rob someone and why he shot and killed the victim. From there we gather and review all his records and history looking for clues to the why. We have gathered an amazing group of speakers who will explain how to recognize issues and problems the client has and explain how those issues and problems affected the moment in time when Thomas killed someone. You may log on or enter the 4th floor conference room of the Mecklenburg County Public Defender’s Office by 11:45am. \nWhere: Anyplace you have internet or the 4th floor conference room (720 E 4th St Charlotte; take the elevator to the 4th floor and the conference room is on your left.) \nWhat:  This one-hour presentation will be divided into four sections: \n\nA brief overview of Incapacity to Proceed (ITP) including a review of the Dusky Standard and how it applied and assessed in North Carolina at the local level and at the state hospital.\nThe fundamentals of capacity restoration will be discussed with a focus on the areas of: psychiatric stability\, knowledge of legal system and individual circumstance\, and development of problem-solving abilities\nReview of the legal and clinical criteria for the three types of capacity restoration programs currently available for Mecklenburg County defendants: Inpatient at Broughton State Psychiatric Hospital\, Detention-based through NC-RISE\, and Outpatient at Atrium Health’s CCRP\nInstruction in court referral process to the various capacity restoration programs with a focus streamlining the assessment/admission process\, reducing delays and the scheduling of unnecessary court hearings\, and allowing defendants to be served in the most appropriate/least restrictive setting.\n\nWho:  \nDr. Anna Abate is a licensed clinical psychologist with specialized expertise in forensic psychology. She earned her Ph.D. from Sam Houston State University\, completing her training through internship at the University of North Carolina and fellowship at the Institute of Law\, Psychiatry\, & Public Policy at the University of Virginia. Her background includes managing research initiatives\, conducting forensic evaluations\, and guiding program evaluation and policy development. Previously\, Dr. Abate served as the Assistant Director of Research at North Carolina State University’s Center for Family and Community Engagement\, where she supported various research and evaluation efforts. Simultaneously\, she managed a private practice\, providing forensic evaluations and mental health assessments for a variety of psycho-legal questions. Currently\, Dr. Abate serves as Program Administrator for the NC RISE program\, where she plays a critical role in overseeing and developing this jail-based capacity restoration program. \n  \nDr. Sherif Soliman is the medical director for the Atrium Health Community Capacity Restoration Program and the Program Director for the Forensic Psychiatry Fellowship Training Program. He is board certified in General\, Forensic\, and Geriatric Psychiatry and is a Clinical Associate Professor at the Wake Forest of Medicine and Atrium Health. In addition\, he holds an academic appointment at Case Western Reserve School of Medicine in Cleveland\, Ohio. He completed medical school (2000)\, psychiatry residency (2004)\, and geriatric psychiatry fellowship (2005) at Wayne State University in Detroit and has completed Forensic Psychiatry fellowship training at Case Western (2006). \nAfter graduating fellowship in 2006\, Dr. Soliman served as an attending psychiatrist at Northcoast Behavioral Healthcare and as the Associate Forensic Director of the former Cleveland Campus of Northcoast. Dr. Soliman’s duties included treating and evaluating forensic and civil patients\, completing forensic reports such as risk assessments and competence to stand trial evaluations\, and designing policies for the treatment and assessment of forensic patients. Dr. Soliman was also forensic psychiatrist at the Cuyahoga County Court Clinic and the City of Cleveland Municipal Court Psychiatric Clinic. Dr. Soliman’s duties included completing forensic reports such as sanity at the time of the act evaluations\, mitigation of penalty evaluations\, and competence to stand trial evaluations\, among others. He served as a CIT trainer for the Cleveland Police Department. \nDr. Soliman moved to Charlotte\, North Carolina in 2018 to join Atrium Health\, where he works as a forensic psychiatrist and an emergency department psychiatrist. In addition\, he does forensic psychiatric evaluations at Broughton Hospital. Dr. Soliman servs as chair of the Geriatric Psychiatry and the Law Committee at the American Academy of Psychiatry and the Law\, is a past president of the Midwest Chapter of the American Academy of Psychiatry and the Law and has been awarded the Award for Best Teacher in a Forensic Fellowship by the American Academy of Psychiatry and the Law. This award is awarded for excellence in teaching forensic psychiatry fellows. Dr. Soliman is active in teaching medical students\, residents\, and fellows. In addition to teaching residents at Atrium Health\, he teaches forensic psychiatry fellows at Case Western Reserve\, residents at Mountain Area Health Education Center (MAHEC)\, and been an invited speaker at other residency programs throughout the country. He has also lectured at Continuing Legal Education conferences and to adult protective services workers. \n  \nStephen Strzelecki\, Psy.D. is a forensic and clinical neuropsychologist who has been licensed in North Carolina since 1995. He has worked in various settings\, including inpatient pediatric rehabilitation\, community mental health\, and private practice\, which also included contractual forensic evaluations through the local mental health Managed Care Organization (MCO) and the NC Department of Juvenile Justice. \nSince 2013\, Dr. Strzelecki has been part of Mecklenburg County’s Criminal Justice Services (CJS)\, where he serves as the Clinical Director of the Forensic Evaluations Unit (FEU).  In this role he oversees the completion of Mecklenburg County court-ordered forensic psychological evaluations from all levels of the judiciary\, as well as behavioral health diversion programs and grant-based projects designed to address the needs of justice involved individuals with severe mental health disorders\, substance use issues\, and intellectual-developmental disabilities. \nProjects in which Dr. Strzelecki is involved include; Understanding the Frequent Utilizer Population research project with Policy Research Associates\, SOAR-Criminal Justice grant project through SAMHSA to expedite access to disability benefits for individuals that are experiencing homelessness and involved with the criminal justice system\, and SAMHSA’s GAINS Center-Learning Collaborative: Competence to Stand Trial/Competence Restoration project with the North Carolina Department of Health and Human Services. \nWithin Mecklenburg County\, Dr. Strzelecki serves as the chair for the Stepping Up Committee\, which is part of a state and national initiative that focuses on reducing the number of individuals with mental illness in jails. He is also a member the Substance Use Disorder Task Force Leadership team\, the Involuntary Commitment Committee\, Juvenile Model Court Committee\, and an instructor with the Mecklenburg County CIT program. \n  \nYolanda Tindal is the program manager for the Atrium Health Community Capacity Restoration Program. As a licensed clinician\, she has over 15 years of experience working closely with populations interacting with mental health services in conjunction with the criminal justice system. Yolanda is currently designing\, implementing and managing a grant funded pilot program provided by the Department of Health and Human Services. DESCRIPTION:Registration for the 2025 Guardianship Proceedings for Appointed Counsel and Civil Commitment Conferences\, co-sponsored by the School of Government and the Office of Indigent Defense Services\, is now open. \nPROGRAM OVERVIEW\, DATES\, AND LOCATION: Both conferences will be held in-person at the School of Government in Chapel Hill and are open to public defenders\, appellate defenders\, and private attorneys representing respondents in civil commitment and guardianship proceedings. \nThe Guardianship Proceedings for Appointed Counsel conference is scheduled for Thursday\, January 16. \n\nTopics will include client competency determinations; recent statutory changes and what they mean for GALs; challenges faced by GALs and how to approach them; and the ethical duties (and dilemmas) common in this work.\n\nThe Civil Commitment Conference is scheduled for Friday\, January 17.  \n\nTopics will include reviewing the nuts and bolts of effective representation in IVC proceedings; client mental health and capacity; defense counsel’s responsibilities after a hearing is finished (including appeals); and what to expect in this practice with E-Courts.\n\nWe will announce the final agendas at a later date\, closer to the programs. \nFEE: The registration fee for private assigned and managed assigned counsel is $175 for the Guardianship Proceedings for Appointed Counsel Conference and $175 for the Civil Commitment Conference. This program will give attorneys tools to help identify whether a client may be on the spectrum and the potential need for further psychological testing or evaluation. Further\, if the attorney can better understand clients on the spectrum\, they can provide a better defense for these clients. The speakers will outline the core features of autism\, with emphasis on common differences in the areas of communication\, social understanding and interaction\, self-management and executive functioning\, and regulation of emotions and behaviors. They will highlight how these differences might manifest in individuals with more nuanced presentations of autism. \nWho: Louise Southern PhD\, LBA\, BCBA\, is the Associate Clinical Director of the Autism Society of North Carolina (ASNC) and has worked with children and adults across the spectrum in a variety of contexts since 1998.  Among other roles\, she leads external clinical training initiatives for the organization. \nEb Roberts JD\, SPHR\, LCMHC\, is the General Counsel and Chief Human Resources Officer for the organization. McLaughlin has been employed as a staff attorney with the North Carolina State Bar since June 2004. Originally from New Jersey\, she graduated from Drew University with a B.A. in English. She obtained her J.D. from Seton Hall University School of Law. As Assistant Ethics Counsel\, she gives informal ethics advice to lawyers about their own future conduct via telephone or email\, prepares formal ethics opinions\, and advises the Ethics Committee. Nichole is also the Judicial District Bar Liaison\, a role created to improve communication between the State Bar and judicial district bars. Nichole has also taught Professional Responsibility at North Carolina Central School of Law. Prior to joining the Bar\, she was in private practice for five years with Donaldson & Black\, P.A. in Greensboro\, and handled asbestos workers’ comp cases. He has practiced criminal defense law for over 40 years\, participated as lead counsel in numerous capital murder trials\, is a recipient of the prestigious J. Kirk Osborn award\, and joined the Office of the Capital Defender in 2017. \n  \n9:00   –  9:15          Register \n9:15   – 10:00         Introduction to Wymore Jury selection \n10:00 – 10:15         Break \n10:15 – 10:45         Case study \n10:45 – 11:15         Good facts/bad facts \n11:15 – 12:00         Demonstration on a life juror and a killer. \n12:00 –  1:30          Lunch (on your own) \n1:30   –  2:30          Jury selection by participants \n2:30   –  2:45          Break \n2:45   –  4:15          Jury selection by participants \n  \nWhat will be covered during each session: \nThe first session introduces the participants to the Wymore method of selecting jurors in a capital case where the government is seeking the death penalty for your client. \nThe second session is a case study. A fictional set of facts describes a murder and describes the life of the person charged with the crime. \nThe third session reviews the case study facts and selects the good facts you want to tell the jury and selects the bad facts you want the jury to know about. \nThe fourth session is a demonstration of questioning a potential juror who you want to keep on your jury. \nThe fifth session is a demonstration of questioning a potential juror who you do not want to keep on your jury. \nThe last two sessions allow the participants to practice jury selection using the Wymore method\, with critique. \n  \n5 hours CLE credit is pending approval. If you want CLE credit the State Bar will bill you for the CLE. \n  \nNOTE: This is a free seminar.
