Thanks to the support of the Office of Indigent Defense Services and the UNC School of Government\, we are pleased to announce that there is no registration fee for indigent defenders who meet the eligibility criteria described below. \n— \nThe 2023 Summer Criminal Law Update will cover recent criminal law decisions issued by the North Carolina appellate courts and U.S. Supreme Court and highlight significant criminal law legislation enacted by the North Carolina General Assembly. School of Government faculty Shea Denning\, Jacqui Greene\, and John Rubin will join Phil Dixon in discussing a wide range of issues affecting felony and misdemeanor cases in the North Carolina state courts. The conference will offer approximately 13.75 hours of attorney CLE credit and qualifies for NC State Bar criminal law specialization credit\, including two ethics hours\, one technology hour\, and one substance abuse/mental health hour. This year’s conference will be held in person May 10-12\, 2023\, at the Winston-Salem Benton Convention Center (301 W 5th St\, Winston-Salem\, NC 27101). \nThis year’s conference topics include emerging issues in Fourth Amendment law\, expert witnesses\, capacity\, motions for appropriate relief\, Second Amendment challenges\, DNA\, sex offender evaluations\, probation\, and more. Stay tuned for the final agenda! \nParticipants:  \nThe Spring Public Defender Conference is open to public defenders\, public defender investigators\, private investigators\, appellate defenders\, capital defenders\, special counsel\, IDS legal staff\, and attorneys from the Center for Death Penalty Litigation (CDPL) and North Carolina Prisoner Legal Services\, Inc. Please see the attached parking map for additional parking options near the convention center and hotel.\n= \nTravel and Reimbursement (State Employees Only): Your eligibility for travel reimbursement at the state rate is contingent on state rules and regulations.  Please review the customized travel expense allowance sheet\, as well as the mileage chart from county seats to Winston-Salem.  As an IDS employee\, your lodging is reimbursable at the state rate for Wednesday and Thursday nights if you must drive more than 35 miles to the conference from your home or office\, whichever is closer. Lodging is not reimbursable for Tuesday night unless you drive more than 185 miles. Breakfast will be provided at no charge on Thursday and Friday; state employees may not claim reimbursement for breakfast. \nThe mileage reimbursement rate is $0.625 per mile for those participants with overnight status who carpool to and from the program. (Those who are not eligible to stay overnight are not required to carpool and will be reimbursed at $0.625 per mile.) If carpool passenger names are not provided\, or if you choose to drive alone\, you will receive $0.33 per mile. This CLE frames face recognition as a biometric investigative technique\, one that has never had its reliability or scientific validity established. It will examine the way face recognition is used in practice\, which carries significant risk for misidentification or other error. Michael focuses on cutting-edge Fourth Amendment issues including the “third-party doctrine\,” location tracking\, device searches\, parallel construction\, and government hacking. He provides trainings and direct legal assistance to equip defense lawyers with the tools they need to ensure that the Fourth Amendment keeps pace with emerging technologies. \nMichael previously served as Senior Counsel for the Brennan Center for Justice at NYU School of Law. As part of the Liberty and National Security program\, Michael worked to oppose discriminatory surveillance and immigration practices\, developed legislation to enhance oversight and accountability for the NYPD\, and co-authored numerous amicus briefs in cases involving electronic surveillance and privacy issues\, including United States v. Jones\, Riley v. California\, and Carpenter v. United States. \nFrom 2008-2011\, Michael was the National Security Coordinator for NACDL\, where he provided legal assistance for the defense of detainees in the military commissions at Guantanamo Bay. Michael is a frequent commentator on privacy and national security issues for national media outlets. He is the author of National Security and Local Police (2013) and Rethinking Privacy: Fourth Amendment “Papers” and the Third-Party Doctrine (2016). He holds a J.D. from NYU School of Law and a B.A. from Columbia University in Political Science and Middle East & Asian Languages and Cultures.

Mr. Williams received a B.A. in Political Science and J.D. from Duke University. He was Chief Public Defender for Orange and Chatham Counties from 1990-2017 and previously the Felony Chief of the Mecklenburg County Public Defender’s Office. While a member of the N.C. Advocates for Justice Board of Governors\, Mr. Williams helped establish and served as Chair of the Task Force on Racial and Ethnic Bias in the Criminal Justice System which ultimately led to the establishment of the NC CRED. Mr. Williams is also a founder and Board member of the N.C. Public Defender Committee on Racial Equity and serves on numerous boards\, including the N.C. Fines and Fees Coalition\, National Consortium on Racial and Ethnic Fairness in the Courts\, N.C. Association of Black Lawyers\, Orange Bias Free Policing Coalition. He serves as Co-chair of the District 18 Bar Racial Justice Force. He has received numerous awards\, including the N.C. Advocates for Justice Thurgood Marshall Award\, the MLK University/ Community Planning Inc. MLK Jr. Citizenship Award\, the N.C. ACLU Champion of Justice Award\, and the North Carolina Bar Association James McNeil Smith Jr. Award. \n\n\n\nJeff Kukucka\, Ph.D. Dr. Kukucka is an Associate Professor of Psychology and Law at Towson University in Maryland\, and Vice Chair of the OSAC for Forensic Science\, Human Factors Task Group. His primary line of research examines the causes of\, and solutions for\, cognitive bias in forensic science judgments\, as well as how non-experts understand forensic evidence. He also regularly works as an expert witness on these issues. \n\n\n\nIn 2009\, he graduated summa cum laude and Phi Beta Kappa from Loyola College in Maryland. As an undergrad\, he became involved in research on conformity and eyewitness memory with Dr. Kerri Goodwin (Towson University) and research on child forensic interviewing and metacognition with Dr. Maggie Bruck (Johns Hopkins University). In 2014\, he graduated from the PhD Program in Psychology & Law at the CUNY Graduate Center\, where he worked under Dr. Saul Kassin (John Jay College of Criminal Justice). \n\n\n\nEmily Coward\, J.D. Emily Coward joined the Decarceration Project as Policy Director in December 2021 and will be joining Duke Law as Director of the new Inclusive Juries Project in August 2022. From 2012 to 2021\, she was a member of the UNC School of Government’s Public Defense Education group\, serving as Director and Project Attorney of the NC Racial Equity Network. She received the UNC School of Government Margaret Taylor Writing Award in 2015 for co-authoring Raising Issues of Race in North Carolina Criminal Cases and the James E. Williams award in 2016 from the North Carolina Public Defenders Association. From 2009 to 2011\, she represented clients in civil and post-conviction matters as an attorney with North Carolina Prisoner Legal Services. Ms. Coward served as a law clerk for Judge James Robertson of the United States District Court for the District of Columbia and for Justice Thembile Skweyiya of the Constitutional Court of South Africa.
