This CLE frames face recognition as a biometric investigative technique\, one that has never had its reliability or scientific validity established. It will examine the way face recognition is used in practice\, which carries significant risk for misidentification or other error. Ways to challenge this use and the potential for producing exculpatory information will also be covered. \nRegistration:\nThis program is part of the 2022 IDS Forensic Science Education Series. Use this link to register for all webinars in the series and attend any that are of interest. \nPresenter:\nMichael Price serves as Litigation Director for the Fourth Amendment Center at NACDL\, which provides the defense bar with resources and litigation support designed to preserve privacy rights in the digital age. Michael focuses on cutting-edge Fourth Amendment issues including the “third-party doctrine\,” location tracking\, device searches\, parallel construction\, and government hacking. He provides trainings and direct legal assistance to equip defense lawyers with the tools they need to ensure that the Fourth Amendment keeps pace with emerging technologies. \nMichael previously served as Senior Counsel for the Brennan Center for Justice at NYU School of Law. As part of the Liberty and National Security program\, Michael worked to oppose discriminatory surveillance and immigration practices\, developed legislation to enhance oversight and accountability for the NYPD\, and co-authored numerous amicus briefs in cases involving electronic surveillance and privacy issues\, including United States v. Jones\, Riley v. California\, and Carpenter v. United States. \nFrom 2008-2011\, Michael was the National Security Coordinator for NACDL\, where he provided legal assistance for the defense of detainees in the military commissions at Guantanamo Bay. Michael is a frequent commentator on privacy and national security issues for national media outlets. He is the author of National Security and Local Police (2013) and Rethinking Privacy: Fourth Amendment “Papers” and the Third-Party Doctrine (2016). He holds a J.D. from NYU School of Law and a B.A. from Columbia University in Political Science and Middle East & Asian Languages and Cultures.

Louisiana\, 419 U.S. 522\, 528 (1975). \n\n\n\nThe right to a jury that is a fair cross-section of the community is a well-known concept for criminal defense attorneys. Mr. Williams received a B.A. in Political Science and J.D. from Duke University. He was Chief Public Defender for Orange and Chatham Counties from 1990-2017 and previously the Felony Chief of the Mecklenburg County Public Defender’s Office. While a member of the N.C. Advocates for Justice Board of Governors\, Mr. Williams helped establish and served as Chair of the Task Force on Racial and Ethnic Bias in the Criminal Justice System which ultimately led to the establishment of the NC CRED. Mr. Williams is also a founder and Board member of the N.C. Public Defender Committee on Racial Equity and serves on numerous boards\, including the N.C. Fines and Fees Coalition\, National Consortium on Racial and Ethnic Fairness in the Courts\, N.C. Association of Black Lawyers\, Orange Bias Free Policing Coalition. He serves as Co-chair of the District 18 Bar Racial Justice Force. He has received numerous awards\, including the N.C. Advocates for Justice Thurgood Marshall Award\, the MLK University/ Community Planning Inc. MLK Jr. Citizenship Award\, the N.C. ACLU Champion of Justice Award\, and the North Carolina Bar Association James McNeil Smith Jr. Award. \n\n\n\nJeff Kukucka\, Ph.D. Dr. Kukucka is an Associate Professor of Psychology and Law at Towson University in Maryland\, and Vice Chair of the OSAC for Forensic Science\, Human Factors Task Group. His primary line of research examines the causes of\, and solutions for\, cognitive bias in forensic science judgments\, as well as how non-experts understand forensic evidence. He also regularly works as an expert witness on these issues. \n\n\n\nIn 2009\, he graduated summa cum laude and Phi Beta Kappa from Loyola College in Maryland. As an undergrad\, he became involved in research on conformity and eyewitness memory with Dr. Kerri Goodwin (Towson University) and research on child forensic interviewing and metacognition with Dr. Maggie Bruck (Johns Hopkins University). In 2014\, he graduated from the PhD Program in Psychology & Law at the CUNY Graduate Center\, where he worked under Dr. Saul Kassin (John Jay College of Criminal Justice). \n\n\n\nEmily Coward\, J.D. Emily Coward joined the Decarceration Project as Policy Director in December 2021 and will be joining Duke Law as Director of the new Inclusive Juries Project in August 2022. From 2012 to 2021\, she was a member of the UNC School of Government’s Public Defense Education group\, serving as Director and Project Attorney of the NC Racial Equity Network. She received the UNC School of Government Margaret Taylor Writing Award in 2015 for co-authoring Raising Issues of Race in North Carolina Criminal Cases and the James E. Williams award in 2016 from the North Carolina Public Defenders Association. From 2009 to 2011\, she represented clients in civil and post-conviction matters as an attorney with North Carolina Prisoner Legal Services. Ms. Coward served as a law clerk for Judge James Robertson of the United States District Court for the District of Columbia and for Justice Thembile Skweyiya of the Constitutional Court of South Africa. After a brief overview of the concepts of likelihood ratio and probabilistic genotyping\, the program will focus on PG output/results and\, in general terms\, what the software is doing to process a sample. \nThe objective of the program is to provide greater understanding of how software is used to interpret complex mixtures of DNA and help attorneys understand the limitations of the software. Use this link to register for all webinars in the series and attend any that are of interest. \nPresenters:\nDr. Maher “Max” Noureddine\nDr. Maher “Max” Noureddine is molecular geneticist with extensive background in scientific research in human genetics and expertise in DNA forensics. He earned his Ph.D. in Molecular Genetics from the University of North Carolina at Chapel Hill. He then completed a postdoctoral fellowship at Duke University Medical Center (The Center for Human Genetics)\, where he published many articles on the genetics of Parkinson Disease and other human genetic disorders. His expertise includes specialized training in complex genomics\, DNA fingerprinting\, mitochondrial genome analysis\, Single Nucleotide Polymorphism studies\, and state of the art methodologies in gene structure and function studies. \nCurrently\, as a recognized forensic DNA expert and President of the forensics consulting company ForensiGen\, LLC\, Dr. Noureddine provides services and expert consultation to law professionals on DNA and serology evidence in criminal and civil cases\, as well as consulting services to the public in the area of genetic testing. \nElizabeth Daniel Vasquez\nElizabeth Daniel Vasquez is the Director of the Science & Surveillance Project at Brooklyn Defender Services in Brooklyn. In that role\, Elizabeth is responsible for developing BDS’s litigation and advocacy strategy surrounding issues of data\, science\, and technology. She consults on cases involving complex forensic science and surveillance issues\, trains the office in litigating and confronting forensic evidence and emerging surveillance techniques\, spearheads affirmative impact litigation emanating from forensic and surveillance abuses\, and coordinates policy and law reform efforts surrounding emerging forensic science and surveillance concerns. Elizabeth has served as a faculty member for the National Forensic Science College\, an adjunct professor at Cardozo Law School\, and a trainer and panelist at numerous local and national convenings on forensic science and surveillance issues. \nBefore joining BDS\, Elizabeth worked as a staff attorney in the trial division of the Public Defender Service (“PDS”) for the District of Columbia. At PDS\, Elizabeth represented adults and juveniles in D.C. Superior and Family Court who were charged with serious felonies. She also served as a member of PDS’s Forensic Practice Group. Before PDS\, Elizabeth was an associate at Neufeld Scheck & Brustin\, LLP\, litigating wrongful conviction and civil rights cases in state and federal courts throughout the country. At NSB\, Elizabeth’s work focused predominantly on complex § 1983 claims that involved faulty forensic evidence. Elizabeth is a cum laude graduate of New York University School of Law\, where she was Editor-in-Chief of the Review of Law and Social Change and participated in Bryan Stevenson’s Equal Justice and Defender Clinic. She received her B.A. with Honors from the University of Chicago.

Dr. Van Wallendael will also discuss the effective use of eyewitness ID experts\, including what information is needed from discovery and in preparation for testimony. \n\n\n\nGreg Tosi will address the effective use of eyewitness ID experts from the attorney’s perspective\, using a case example. His practice is based in Charlotte. Prior to going into private practice\, he worked as an Assistant Public Defender for Mecklenburg County for nearly 10 years. Mr. Tosi received his J.D. from Northeastern University School of Law in Boston\, MA. During his time there\, he completed four legal internships with the Massachusetts Attorney General\, Ferguson\, Stein\, Chambers Gresham & Sumter\, Gillis & Bikofsky\, and NC Superior Court Judge William Z.
