SUMMARY:Intensive Juvenile Defender Training
DESCRIPTION:We are excited to announce that the Intensive Juvenile Defender Training\, co-sponsored by the School of Government and the Office of Indigent Defense Services\, will be held Thursday\, March 7\, through Friday\, March 8\, at the Guilford Technical Community College – Jamestown Campus (621 East Main Street\, Jamestown NC 27282). \nPROGRAM: This year’s training will offer a new experience. First\, attendees will hear from experts on topics including juvenile interrogations\, secured custody\, and probable cause. We will also have a discussion about youth and gangs\, taught by Dr. Steven R. Cureton\, Professor and Department Head of Sociology\, Criminology and Justice Studies\, UNC Greensboro. \nOther sessions\, subject to Bar approval\, will satisfy attorneys’ mental health and technology CLE requirements\, including a session on juvenile defense and E-Courts. Attendees will have the opportunity to tour the Guilford Juvenile Detention facility\, hear from the facility’s director\, as well as juveniles who have experienced the system\, and discuss the needs of youth and other matters of concern to defenders. DESCRIPTION:Does your criminal defense work have you stressed\, frazzled\, and overwhelmed?  \nLooking for an option that is accessible and can provide immediate relief?  \nResearch shows that mindfulness-based practices can improve overall health and well-being in a relatively short period of time. \nIn the midst of our striving\, achieving\, tending to the needs of others\, we rarely find time to slow down and make time for ourselves. You work long hours\, in an adversarial system\, often skip meals\, and rarely have time for a break. Her forensic training includes a predoctoral forensic psychology internship at the Federal Bureau of Prisons in San Diego and a postdoctoral fellowship at an esteemed private clinical and forensic psychology practice. She gained experience in various settings in California and North Carolina including a private psychiatric hospital\, a psychiatric residential facility\, a federal correctional center\, a juvenile youth development center\, and in Mecklenburg County government before she established a successful private practice specializing in forensic\, clinical\, and neuropsychological evaluations. She is now dedicated to providing consultation and evaluations in the context of criminal forensic psychology. \nDr. Virginia Hart is a highly qualified forensic expert with over 20 years of experience in forensic and clinical psychology. She obtained a PhD in Clinical Psychology with a subspecialty in Psychology and Law from the University of Alabama. Dr. Hart’s extensive forensic training includes a Forensic Psychology predoctoral internship via the Federal Bureau of Prisons and a Forensic Psychology postdoctoral fellowship through the University of Virginia Institute of Law\, Psychology and Public Policy. She has a broad range of experience working in various clinical settings\, including correctional facilities\, state hospitals\, forensic state hospitals\, inpatient units\, and outpatient settings. Dr. Hart is a published researcher in her field and currently serves as an assistant professor with the Wake Forest School of Medicine Department of Psychiatry. Dr. Hart specializes in criminal forensic evaluations and expert services. \nDr. Terri Watters Klosek has extensive experience with the intersection of psychology and law. She holds a doctorate in forensic psychology from the California School of Professional Psychology. Her training includes a forensic pre-doctoral internship with the Bureau of Prisons\, as well as a forensic postdoctoral fellowship through Harvard Medical School/Massachusetts General Hospital. She has worked in a variety of settings including correctional facilities\, and forensic hospitals as well as general clinical inpatient and outpatient settings. The conference room will open by 12:15pm. \nWhat: The presenter has firsthand knowledge of being prosecuted\, convicted\, sentenced to prison and released. He will talk about his experience being defended\, at first\, by an assistant public defender before his family hired an attorney. From this experience\, he will share what worked and didn’t during his representation by both an assistant public defender and private defense attorney. He will then discuss his experience in prison\, so the criminal defense attorney has a better idea of what their clients may experience in prison. With this knowledge\, the attorney will be able to better argue for sentences that either do not involve prison or are less time in prison. The presenter will share his experiences after release from prison and the challenges and surprises he faced so the criminal defense attorney can know what their clients may face and are better able to inform those clients now. Finally\, he will discuss the creation of the non-profit OurJourney that assists others who are released from prison. \nWho: Brian Scott was arrested in 2001 and spent 20 years in the North Carolina state prison system. One year after his release\, he used his own struggles with reentry as motivation to found OurJourney\, a statewide nonprofit organization that works to make the reentry experience more successful and easier to navigate for others. \nQuestions? DESCRIPTION:We are excited to announce that the 2024 Defender Trial School\, cosponsored by the School of Government and the North Carolina Office of Indigent Defense Services\, will be held Monday\, July 8 through Friday\, July 12 at the School of Government. The program will offer approximately 29.5 hours of CLE credit\, including one hour of  Ethics credit\, and qualifies for NC State Bar criminal law specialization credit. \nParticipants will use their own non-capital cases to develop a cohesive theory of defense at trial and apply that theory through all stages of a trial\, including voir dire\, opening and closing arguments\, and direct and cross-examination. \nWe are also excited to inform you that IDS has expanded the number of fellowships (scholarships) available to attend the Trial School. Please review the information below before registering\, including the registration deadlines and the instructions about obtaining a fellowship. \n***LINK TO AGENDA***\nPARTICIPANTS \nThe Defender Trial School is open to public defenders and\, space permitting\, private attorneys who perform a significant amount of appointed work. \nBecause space is limited at the Trial School\, public defenders must receive approval from their Chief Public Defenders prior to registering. You do not need to send us anything formal from your chief defender\, but please obtain approval before registering. \n  \nATTENDANCE \nUnlike other programs\, you need to attend all of the sessions. Everyone registered will receive a Webex link to join on Friday August 2nd. \nWhat: The presenter will discuss how to help a client at federal sentencing when there are pending and/or related state cases that can impact sentence length and credit. The concepts of primary and secondary custody will be covered so the attorney understands how the Federal Bureau of Prisons calculates pre-sentence credit and also which judge—the state or federal judge—will be deemed (by the federal BOP) to determine whether sentences are consecutive or concurrent. This information will also be helpful to the attorney helping a client at state sentencing when there are pending and/ or related federal cases. In federal court\, when we prepare for sentencing\, we focus—rightfully—on telling our client’s story\, relating that story to 3553(a) factors\, and correctly assessing the guideline range. But when our client has other cases out there\, we also need to understand how the federal sentence will relate to other state sentences\, to make sure that our client won’t end up serving more time than we expect.  \nWho: Shelley Fite serves as National Sentencing Resource Counsel for the Federal Public & Community Defenders\, in which role she assists defenders and other CJA-appointed counsel around the country who are litigating complex sentencing issues. Although Shelley was born and raised in Florida\, she has spent her professional career in Wisconsin as a public defender of one kind or the other and is based in Madison\, Wisconsin. After graduating magna cum laude from the University of Wisconsin Law School in 2006 and clerking for U.S. District Judge Lynn Adelman\, Shelley worked first an appellate attorney with Wisconsin’s State Public Defender and then an associate federal defender with Federal Defender Services of Wisconsin. DESCRIPTION:The Mecklenburg County Public Defender’s Office is hosting a free to attend presentation on LC/MS and its Application in Forensic Toxicology. This presentation is approved for 1 general CLE hour by the NC State Bar. Unlike other forms of analytical testing\, LC/MS relies on the principles of chromatography and mass spectrometry coupled together to determine substances. This presentation dives into this testing method and how it offers undeniable detection of substances and can help attorneys understand why it is needed. Additionally\, I will provide a connection between how forensic chemistry can be used to ultimately understand the pharmacological and toxicology of elicit substances and their impacts to the human body. These pieces of evidence can be critical for attorneys and defense attorneys in truly understanding their clients situations. \nWho: Dr. Rohan Parekh is a chemist by training with a plethora of experience dealing with analytical instruments and techniques such as chromatography and mass spectrometry. He has over 5 years of experience working in industry with these analytical techniques as well as a masters in Chemistry from East Carolina University. Dr. Parekh has also completed a PhD in Pharmacology and Toxicology from the Brody School of Medicine which has provided a strong understanding of drug metabolism and pharmacokinetics and pharmacodynamics\, which aids in his ability to serve as an expert. Dr. Parekh has been published in numerous journals including Nature\, and has taught numerous seminars and courses on drug chemistry\, pharmacology and toxicology. These activities validate Dr. Parekh has developed a keen understanding of translational medicine and how drugs/toxicants and their basic chemical reactions can result in direct effects in humans and can alter their states of consciousness and ensuing actions. \nFor those that may have toxicology evidence in their criminal case\, Dr. Parekh is willing to give a free mini-consult on April 26th so you can decide whether you would like to retain him for your case. The program consists of a mix of lectures and intensive small-group workshops. You must take the following steps BEFORE you can register. \n\nIf you are in a public defender’s office\, you must obtain the approval of your Chief Public Defender to register. Because of limited space\, each office is allotted one slot.\nIf you are a private assigned and managed assigned counsel\, you must currently represent appointed felony clients to register.\n\nCLE CREDIT: We have applied for 12.25 hours of credit (including 1.0 hours of ethics credit). We may not know what to say when someone expresses a threat; it is devastating when we lose someone by suicide and replay in our minds the threats\, both direct and indirect\, that she/he made prior to ending her/his life. Yet\, we are only responsible to do what we know to do at the time it needs doing\, not for the things that we learn to do later. \nQPR was created to be a universal intervention for anyone experiencing emotional distress.
