The session will provide defenders with an understanding of the current state of criminal law and marijuana\, and will offer defenders strategies to litigate suppression and evidentiary challenges in marijuana prosecutions in the state. \nWho:  Phil Dixon practiced criminal law in Greenville\, NC\, and surrounding areas for more than nine years before coming to the UNC School of Government in 2017. He is the director of the public defense education team and a Teaching Associate Professor of criminal law and procedure at the School. Among other areas\, he focuses on criminal drug law. DESCRIPTION:Registration is open for the 2024 North Carolina Appellate Advocacy Training\, sponsored by the School of Government and the Office of Indigent Defense Services. \nAgenda\nGuide for Participants\n  \nPARTICIPANTS: The Appellate Advocacy Training is open to assistant appellate defenders and attorneys on the appellate appointment list maintained by the Office of the Appellate Defender. Eligibility questions should be directed to Glenn Gerding at (919) 354-7210 or glenn.g.gerding@nccourts.org. \n  \nREQUIREMENTS: To prepare for the program\, please read the Guide for Participants\, which is attached and is also posted on the course webpage under the “Materials” tab. \nAt the end of the guide\, there is a form to fill out summarizing the non-capital case you will work on at the program. Every registrant MUST complete and return the form via email to Bob Burke at  oldhoopster@hotmail.com no later than noon on Monday\, October 7.  If you have questions about the case you should bring\, contact Appellate Defender Glenn Gerding. Private lawyers may bill up to 4 hours for the work done on their own cases at this program. \n  \nYou will be doing writing during the breakout sessions. Plan to bring a laptop or other electronic writing device. \n  \nLOCATION\, DATE\, & TIME: The training will be held Wednesday\, October 23\, through Friday\, October 25\, 2024\, at the School of Government in Chapel Hill. She is now dedicated to providing consultation and evaluations in the context of criminal forensic psychology. \nDr. Virgina Hart is a highly qualified forensic expert with over 20 years of experience in forensic and clinical psychology. She obtained a PhD in Clinical Psychology with a subspecialty in Psychology and Law from the University of Alabama. Dr. Hart’s extensive forensic training includes a Forensic Psychology predoctoral internship via the Federal Bureau of Prisons and a Forensic Psychology postdoctoral fellowship through the University of Virginia Institute of Law\, Psychology and Public Policy. The conference room will open by 12:15pm \nWhat: The speakers will discuss the collateral consequences of juvenile adjudications and why taking steps to expunge these adjudications are so important. They will next discuss the process to obtain expunctions of juvenile adjudications as well as certain criminal convictions obtained prior to Raise the Age. \nWho: \nVeronika Monteleone graduated from Carolina Law with honors in 2015. She began her legal career at the Council for Children’s Rights representing children in both civil commitment proceedings and juvenile delinquency matters. She became a board-certified specialist in Juvenile Delinquency Law in 2021 and is a certified Juvenile Training Immersion Program Trainer. She is currently an Assistant Public Defender with the Mecklenburg County Public Defender’s Office. Prior to her current role\, she was an Assistant Public Defender and Juvenile Court Supervisor at the Gaston County Public Defender’s Office. \nCourtney Viebrock manages the Pro Bono Program for the Charlotte Center for Legal Advocacy. In this program\, she engages Charlotte’s legal community in serving the Advocacy Center’s clients by partnering with firms\, in-house attorneys at financial institutions and corporations\, and community organizations. The Pro Bono Program supports each program by sending cases to pro bono attorneys and holding clinics using volunteer attorneys and legal professionals. Before joining the Advocacy Center in March 2023\, Courtney began her legal career administering research and development of federal government contracts with the National Institute of Allergy and Infectious Diseases. After moving to Charlotte\, she transitioned to criminal law\, working for the Mecklenburg County District Attorney’s Office for five years. As an Assistant District Attorney\, she prosecuted misdemeanor and felony cases through all stages in district\, juvenile\, and superior court while gaining valuable bench and jury trial experience. DESCRIPTION:Registration is OPEN! \nWe are pleased to announce that the 2024 Higher-Level Felony Defense training\, cosponsored by the School of Government and the Office of Indigent Defense Services\, will take place on Tuesday\, September 10 through Thursday\, September 12\, 2024\, at the School of Government. \nPARTICIPANTS: This program is for attorneys interested in handling higher-level felony cases at the trial level. Topics will include preparing for serious felony cases\, eyewitness identifications\, habitual felons\, self-defense\, client relations and rapport\, sentencing law and advocacy\, and mitigation investigation. The program consists of a mix of lectures and intensive small-group workshops. Due to the program’s interactive nature\, participants must attend all sessions. \nAGENDA AND REGISTRATION: The agenda will be posted soon on the course page. The course registration deadline is Friday\, August 30\, at 5:00pm\, but seats may fill quickly\, and capacity is limited\, so do not wait to apply! \nThe Office of Indigent Defense Services has agreed to fund registration for all participants\, including private assigned and managed assigned counsel (although they remain responsible for the cost of their travel\, lodging\, and meals other than lunches and snacks provided during the training). \nDue to the expected level of interest\, the intensive nature of the training\, and limits on seating capacity\, the program is capped at a total of 34 participants. Unlike other forms of analytical testing\, LC/MS relies on the principles of chromatography and mass spectrometry coupled together to determine substances. This presentation dives into this testing method and how it offers undeniable detection of substances and can help attorneys understand why it is needed. Additionally\, I will provide a connection between how forensic chemistry can be used to ultimately understand the pharmacological and toxicology of elicit substances and their impacts to the human body. These pieces of evidence can be critical for attorneys and defense attorneys in truly understanding their clients situations. \nWho: Dr. Rohan Parekh is a chemist by training with a plethora of experience dealing with analytical instruments and techniques such as chromatography and mass spectrometry. He has over 5 years of experience working in industry with these analytical techniques as well as a masters in Chemistry from East Carolina University. Dr. Parekh has also completed a PhD in Pharmacology and Toxicology from the Brody School of Medicine which has provided a strong understanding of drug metabolism and pharmacokinetics and pharmacodynamics\, which aids in his ability to serve as an expert. Dr. Parekh has been published in numerous journals including Nature\, and has taught numerous seminars and courses on drug chemistry\, pharmacology and toxicology. These activities validate Dr. Parekh has developed a keen understanding of translational medicine and how drugs/toxicants and their basic chemical reactions can result in direct effects in humans and can alter their states of consciousness and ensuing actions. \nFor those that may have toxicology evidence in their criminal case\, Dr. Parekh is willing to give a free mini-consult on April 26th so you can decide whether you would like to retain him for your case. Everyone registered will receive a Webex link to join on Friday August 2nd. \nWhat: The presenter will discuss how to help a client at federal sentencing when there are pending and/or related state cases that can impact sentence length and credit. The concepts of primary and secondary custody will be covered so the attorney understands how the Federal Bureau of Prisons calculates pre-sentence credit and also which judge—the state or federal judge—will be deemed (by the federal BOP) to determine whether sentences are consecutive or concurrent. This information will also be helpful to the attorney helping a client at state sentencing when there are pending and/ or related federal cases. In federal court\, when we prepare for sentencing\, we focus—rightfully—on telling our client’s story\, relating that story to 3553(a) factors\, and correctly assessing the guideline range. But when our client has other cases out there\, we also need to understand how the federal sentence will relate to other state sentences\, to make sure that our client won’t end up serving more time than we expect.  \nWho: Shelley Fite serves as National Sentencing Resource Counsel for the Federal Public & Community Defenders\, in which role she assists defenders and other CJA-appointed counsel around the country who are litigating complex sentencing issues. Although Shelley was born and raised in Florida\, she has spent her professional career in Wisconsin as a public defender of one kind or the other and is based in Madison\, Wisconsin. After graduating magna cum laude from the University of Wisconsin Law School in 2006 and clerking for U.S. District Judge Lynn Adelman\, Shelley worked first an appellate attorney with Wisconsin’s State Public Defender and then an associate federal defender with Federal Defender Services of Wisconsin. DESCRIPTION:We are excited to announce that the 2024 Defender Trial School\, cosponsored by the School of Government and the North Carolina Office of Indigent Defense Services\, will be held Monday\, July 8 through Friday\, July 12 at the School of Government. The program will offer approximately 29.5 hours of CLE credit\, including one hour of  Ethics credit\, and qualifies for NC State Bar criminal law specialization credit. \nParticipants will use their own non-capital cases to develop a cohesive theory of defense at trial and apply that theory through all stages of a trial\, including voir dire\, opening and closing arguments\, and direct and cross-examination. \nWe are also excited to inform you that IDS has expanded the number of fellowships (scholarships) available to attend the Trial School. Please review the information below before registering\, including the registration deadlines and the instructions about obtaining a fellowship. \n***LINK TO AGENDA***\nPARTICIPANTS \nThe Defender Trial School is open to public defenders and\, space permitting\, private attorneys who perform a significant amount of appointed work. \nBecause space is limited at the Trial School\, public defenders must receive approval from their Chief Public Defenders prior to registering. You do not need to send us anything formal from your chief defender\, but please obtain approval before registering. \n  \nATTENDANCE \nUnlike other programs\, you need to attend all of the sessions. The sessions build on one another\, and by the end of the program\, you will have developed a comprehensive strategy for trying your case. \n  \nLOCATION\, DATES\, AND TIMES \nThe program will be held Monday\, July 8\, through Friday\, July 12\, at the School of Government on the UNC-Chapel Hill campus. This year’s conference will be held in person on May 8-10\, 2024\, at the Winston-Salem Benton Convention Center (301 W 5th St\, Winston-Salem\, NC 27101).  \nConference topics will include emerging Fourth Amendment issues\, prosecutor misconduct\, forensics\, client-centered advocacy\, driving while impaired\, evidence\, satellite-based monitoring\, calendaring authority\, and more. \nClick HERE for the agenda. \nParticipants: The Spring Public Defender Conference is open to public defenders\, public defender investigators\, private investigators\, appellate defenders\, capital defenders\, special counsel\, IDS legal staff\, and attorneys from the Center for Death Penalty Litigation and North Carolina Prisoner Legal Services\, Inc. \nThis year’s conference will not include a separate track for investigators; however\, investigators may find the sessions helpful to their work and are welcome to attend. \nRegistration and Fees: To register and find other program information\, click here to visit the course page. Please see the attached parking map for additional parking options near the convention center and hotel. \nTravel and Reimbursement (State Employees Only): Your eligibility for travel reimbursement at the state rate is contingent on state rules and regulations.  A customized travel expense allowance sheet\, as well as a mileage chart from county seats to Winston-Salem\, is available on the conference website.  As an IDS employee\, your lodging is reimbursable at the state rate for Wednesday and Thursday nights if you must drive more than 35 miles to the conference from your home or office\, whichever is closer. Lodging is not reimbursable for Tuesday night unless you drive more than 185 miles. Breakfast will be provided at no charge on Thursday and Friday; state employees may not claim reimbursement for breakfast. \nThe mileage reimbursement rate is $0.625 per mile for those participants with overnight status who carpool to and from the program. (Those who are not eligible to stay overnight are not required to carpool and will be reimbursed at $0.625 per mile.) If carpool passenger names are not provided\, or if you choose to drive alone\, you will receive $0.33 per mile.
