DESCRIPTION:Please join School of Government faculty members Timothy Heinle and Meredith Smith as they host two webinars in December that will highlight changes to adult guardianship proceedings resulting from Session Law 2023-124.  \nPlease see below for specific details about the webinars and to register for each. \nDecember 7\, 2023: Practical Considerations for Implementing Session Law 2023-124 and the Notice of Rights for Respondents and Wards \nSession Law 2023-124 creates the new G.S. 35A-1117 which entitles respondents and wards to notice of nearly twenty enumerated rights. With this notice of rights comes new responsibilities for guardian ad litems\, clerks of superior court\, and petitioners. In this webinar\, we will anticipate challenges and consider solutions to satisfy the requirements and purpose of the law. Please view the webinar course page for more information and to register for the session on December 7. \nDecember 14\, 2023: Meaningful Consideration of Less Restrictive Alternatives to Guardianship under Session Law 2023-124 \nRecent changes to North Carolina’s guardianship laws make clear that an adult or emancipated minor does not lack capacity (and is therefore not incompetent) if a less restrictive alternative to guardianship enables them to manage their affairs and make and communicate important decisions about themselves and their property. This webinar will discuss these recent changes\, identify examples of less restrictive alternatives\, facilitate participant generated ideas for implementing these alternatives\, identify open questions and anticipated challenges\, and highlight how these changes impact the duties of clerks and guardian ad litem attorneys. She obtained a PhD in Clinical Psychology with a subspecialty in Psychology and Law from the University of Alabama. He will then discuss his experience in prison\, so the criminal defense attorney has a better idea of what their clients may experience in prison. With this knowledge\, the attorney will be able to better argue for sentences that either do not involve prison or are less time in prison. The presenter will share his experiences after release from prison and the challenges and surprises he faced so the criminal defense attorney can know what their clients may face and are better able to inform those clients now. Finally\, he will discuss the creation of the non-profit OurJourney that assists others who are released from prison. \nWho: Brian Scott was arrested in 2001 and spent 20 years in the North Carolina state prison system. Lodging is not reimbursable for Tuesday night unless you drive more than 185 miles. Breakfast will be provided at no charge on Thursday and Friday; state employees may not claim reimbursement for breakfast. \nThe mileage reimbursement rate is $0.625 per mile for those participants with overnight status who carpool to and from the program. (Those who are not eligible to stay overnight are not required to carpool and will be reimbursed at $0.625 per mile.) If carpool passenger names are not provided\, or if you choose to drive alone\, you will receive $0.33 per mile. SUMMARY:2024 Defender Trial School
DESCRIPTION:We are excited to announce that the 2024 Defender Trial School\, cosponsored by the School of Government and the North Carolina Office of Indigent Defense Services\, will be held Monday\, July 8 through Friday\, July 12 at the School of Government. The program will offer approximately 29.5 hours of CLE credit\, including one hour of  Ethics credit\, and qualifies for NC State Bar criminal law specialization credit. \nParticipants will use their own non-capital cases to develop a cohesive theory of defense at trial and apply that theory through all stages of a trial\, including voir dire\, opening and closing arguments\, and direct and cross-examination. \nWe are also excited to inform you that IDS has expanded the number of fellowships (scholarships) available to attend the Trial School. Please review the information below before registering\, including the registration deadlines and the instructions about obtaining a fellowship. \n***LINK TO AGENDA***\nPARTICIPANTS \nThe Defender Trial School is open to public defenders and\, space permitting\, private attorneys who perform a significant amount of appointed work. \nBecause space is limited at the Trial School\, public defenders must receive approval from their Chief Public Defenders prior to registering. You do not need to send us anything formal from your chief defender\, but please obtain approval before registering. \n  \nATTENDANCE \nUnlike other programs\, you need to attend all of the sessions. The sessions build on one another\, and by the end of the program\, you will have developed a comprehensive strategy for trying your case. \n  \nLOCATION\, DATES\, AND TIMES \nThe program will be held Monday\, July 8\, through Friday\, July 12\, at the School of Government on the UNC-Chapel Hill campus. Check-in is on Monday from 8:00 am to 8:45 am\, and the program ends around 1:00 pm on Friday. Lunch is available in the building on Monday through Thursday. The agenda is available on the course page. \n  \nREGISTRATION \nThere is no registration fee for IDS employees. If you are interested in attending\, register as soon as possible. DESCRIPTION:The Federal Public Defender for the Western District of North Carolina and the Mecklenburg County Public Defender’s Office are co-hosting a free-to-attend\, live webinar on Making Sure the Sentence You are Asking for is the One You Want.  \nPending approval by the NC State Bar\, this presentation is for 1 general hour. If you need CLE credit\, you must complete the post-CLE survey.  \nPlease register by Friday August 2nd at noon:   Register for August 5th  \nWhen: Monday August 5\, 2024 from 12:30-1:30pm. You may log on by 12:15. \nWhere: Anyplace you have internet. Everyone registered will receive a Webex link to join on Friday August 2nd. \nWhat: The presenter will discuss how to help a client at federal sentencing when there are pending and/or related state cases that can impact sentence length and credit. The concepts of primary and secondary custody will be covered so the attorney understands how the Federal Bureau of Prisons calculates pre-sentence credit and also which judge—the state or federal judge—will be deemed (by the federal BOP) to determine whether sentences are consecutive or concurrent. This information will also be helpful to the attorney helping a client at state sentencing when there are pending and/ or related federal cases. In federal court\, when we prepare for sentencing\, we focus—rightfully—on telling our client’s story\, relating that story to 3553(a) factors\, and correctly assessing the guideline range. But when our client has other cases out there\, we also need to understand how the federal sentence will relate to other state sentences\, to make sure that our client won’t end up serving more time than we expect.  \nWho: Shelley Fite serves as National Sentencing Resource Counsel for the Federal Public & Community Defenders\, in which role she assists defenders and other CJA-appointed counsel around the country who are litigating complex sentencing issues. Although Shelley was born and raised in Florida\, she has spent her professional career in Wisconsin as a public defender of one kind or the other and is based in Madison\, Wisconsin. After graduating magna cum laude from the University of Wisconsin Law School in 2006 and clerking for U.S. District Judge Lynn Adelman\, Shelley worked first an appellate attorney with Wisconsin’s State Public Defender and then an associate federal defender with Federal Defender Services of Wisconsin. This training will provide a brief overview of data related to specific population groups that statistics show have higher rates of suicide\, including attorneys. Carla also spent time working in Wake County Public Schools\, providing support for children and adolescents diagnosed with Severe and Persistent Mental Illness (SPMI). She later transitioned to working with Alliance Health\, a local managed care organization. We may not know what to say when someone expresses a threat; it is devastating when we lose someone by suicide and replay in our minds the threats\, both direct and indirect\, that she/he made prior to ending her/his life. Yet\, we are only responsible to do what we know to do at the time it needs doing\, not for the things that we learn to do later. \nQPR was created to be a universal intervention for anyone experiencing emotional distress.
