SUMMARY:2023 Defender Trial School
DESCRIPTION:We are excited to announce that the 2023 Defender Trial School\, cosponsored by the UNC School of Government and the North Carolina Office of Indigent Defense Services\, will be held Monday\, July 10 through Friday\, July 14 at the School of Government. \nParticipants will use their own cases to develop a cohesive theory of defense at trial and apply that theory through all stages of a trial\, including voir dire\, opening and closing arguments\, and direct and cross-examination. \nIDS will be offering several scholarships to the 2023 Defender Trial School. SUMMARY:2023 Higher-Level Felony Defense Training
DESCRIPTION:We are pleased to announce that the 2023 Higher-Level Felony Defense Training\, cosponsored by the School of Government and the Office of Indigent Defense Services\, will take place on September 12-14\, 2023\, at the School of Government.  \nLINK TO AGENDA \nPARTICIPANTS: This program is for attorneys interested in handling higher-level felony cases at the trial level. Topics will include preparing for serious felony cases\, eyewitness identifications\, habitual felons\, self-defense\, client relations and rapport\, sentencing law and advocacy\, and mitigation investigation. The program consists of a mix of lectures and intensive small-group workshops. Due to the program’s interactive nature\, participants must attend all sessions. \nAGENDA AND REGISTRATION: The agenda is posted on the course page linked below. The course registration deadline is Wednesday\, August 30\, at 5:00pm\, but seats may fill quickly\, and capacity is limited\, so do not wait to apply! \nThe Office of Indigent Defense Services has agreed to fund registration for all participants\, including contract attorneys and private assigned counsel (although they remain responsible for the cost of their travel\, lodging\, and meals other than lunches and snacks provided during the training). \nDue to the expected level of interest\, the intensive nature of the training\, and limits on seating capacity\, the program is capped at a total of 36 participants. You must take the following steps BEFORE you can register. \n\nIf you are in a public defender’s office\, you must obtain the approval of your Chief Public Defender to register. DESCRIPTION:Indigent Defense Services in collaboration with Alliance Health\nAdult Mental Health First Aid\nFriday\, October 6th\, 9:00 am-2:30pm via Zoom \n*Approximately 2 hours out-of-training curriculum must be completed 48 hours prior to live date* \n*This course is limited to 30 participants* \nSchedule:  9:00am-2:30pm (Live\, virtual Zoom) \nAdult Mental Health First Aid: Adult Mental Health First Aid teaches people how to recognize signs of mental health or substance use challenges in adults ages 18 and older\, how to offer and provide initial help\, and how to guide a person toward appropriate care if necessary. Topics covered include anxiety\, depression\, psychosis\, and addictions. ​ \nThis training will provide attorneys and indigent defense staff with valuable knowledge to recognize when a client’s capacity to make adequately considered decisions in connection with representation is diminished due to a mental health crises or substance use. Steps to take to preserve the attorney-client relationship and attorney-client communication will be covered. The program will also cover actions necessary to preserve the client’s or another’s safety\, in accordance with the NC Rules of Professional Conduct. \nThis virtual learning experience includes two hours of self-paced learning followed by four hours of virtual live instruction. The pre-work must be completed 48 hours before the class begins to be granted access to the course by MHFA USA. \nPresenter:\nJames Osborn is a Licensed Psychologist and Licensed Clinical Addiction Specialist with over 30 years of experience. He has worked in a wide variety of settings in various roles – inpatient\, outpatient\, crisis and assessment\, vocational rehabilitation\, and administration. He is the Director of Community Education and Outreach with Alliance Health\, the local management entity and management care organization (LME/MCO) for Cumberland\, Durham\, Johnston\, Mecklenburg\, Orange\, and Wake County. types of capacity restoration programs currently available for Mecklenburg County defendants: Inpatient at Broughton State Psychiatric Hospital\, Detention-based through NC-RISE\, and Outpatient at Atrium Health’s CCRP\nInstruction in court referral process to the various capacity restoration programs with a focus streamlining the assessment/admission process\, reducing delays and the scheduling of unnecessary court hearings\, and allowing defendants to be served in the most appropriate/least restrictive setting.\n\nWho: \nNathan Andrews\, Psy.D.\, was first licensed as a psychologist in 2010 in the state of Ohio.  He was licensed in New Mexico in 2012 and in 2017 in the state of Washington.  He has been licensed in North Carolina since February 2023.  He has worked in various forensic settings\, including outpatient\, inpatient\, and correctional settings.  He has completed various forensic evaluations including sex offender risk assessments\, dangerousness evaluations\, mental state evaluations\, parenting evaluations\, and disability evaluations.  Dr. Andrews has also taught psychopharmacology for a Master’s of Social Work program at New Mexico Highlands University.  He also taught online courses for several years for the Master of Arts Psychology program for Southern New Hampshire University. \nPrimarily\, Dr. Andrews has been involved in evaluating competency to stand trial\, or as it is defined in North Carolina\, Capacity to Proceed.  For about 11 years\, his primary responsibility was evaluating competency to stand trial for defendants in inpatient treatment settings and in-custody.  He has completed over 950 competency or capacity evaluations in his career.  He has testified as an expert witness on these issues in Ohio\, New Mexico\, and Washington on over 50 different occasions\, for both the defense and prosecution. \nDr. Andrews is now the program director of the NC RISE (Restoring Individuals Safely and Effectively) program\, operated by Wellpath Recovery Solutions.  The NC RISE program began accepting residents for detention-based capacity restoration on December 7\, 2022.  Dr. Andrews also serves as the primary forensic psychologist/evaluator for the program and completes all of the capacity evaluations. \n  \nDr. Sherif Soliman is the medical director for the Atrium Health Community Capacity Restoration Program and the Program Director for the Forensic Psychiatry Fellowship Training Program.  He is Board Certified in General\, Forensic\, and Geriatric Psychiatry and is a Clinical Associate Professor at the Wake Forest of Medicine and Atrium Health.  In addition\, he holds an academic appointment at Case Western Reserve School of Medicine in Cleveland\, Ohio.  He completed medical school (2000)\, psychiatry residency (2004)\, and geriatric psychiatry fellowship (2005) at Wayne State University in Detroit and has completed Forensic Psychiatry fellowship training at Case Western (2006). \nAfter graduating fellowship in 2006\, Dr. Soliman served as an attending psychiatrist at Northcoast Behavioral Healthcare and as the Associate Forensic Director of the former Cleveland Campus of Northcoast.  Dr. Soliman’s duties included treating and evaluating forensic and civil patients\, completing forensic reports such as risk assessments and competence to stand trial evaluations\, and designing policies for the treatment and assessment of forensic patients.  Dr. Soliman was also forensic psychiatrist at the Cuyahoga County Court Clinic and the City of Cleveland Municipal Court Psychiatric Clinic.  Dr. Soliman’s duties included completing forensic reports such as sanity at the time of the act evaluations\, mitigation of penalty evaluations\, and competence to stand trial evaluations\, among others.  He served as a CIT trainer for the Cleveland Police Department. \nDr. Soliman moved to Charlotte\, North Carolina in 2018 to join Atrium Health\, where he works as a forensic psychiatrist and an emergency department psychiatrist.  In addition\, he does forensic psychiatric evaluations at Broughton Hospital.  Dr. Soliman servs as chair of the Geriatric Psychiatry and the Law Committee at the American Academy of Psychiatry and the Law\, is a past president of the Midwest Chapter of the American Academy of Psychiatry and the Law\, and has been awarded the Golden Apple Award by the American Academy of Psychiatry and the Law.  This award is awarded for excellence in teaching forensic psychiatry fellows.  Dr. Soliman is active in teaching medical students\, residents\, and fellows.  In addition to teaching residents at Atrium Health\, he teaches forensic psychiatry fellows at Case Western Reserve\, residents at Mountain Area Health Education Center (MAHEC)\, and been an invited speaker at other residency programs throughout the country.  He has also lectured at Continuing Legal Education conferences and to adult protective services workers. \n  \nStephen Strzelecki\, Psy.D. is a forensic and clinical neuropsychologist who has been licensed in North Carolina since 1995. He has worked in various settings\, including inpatient pediatric rehabilitation\, community mental health\, and private practice\, which also included contractual forensic evaluations through the local mental health Managed Care Organization (MCO) and the NC Department of Juvenile Justice. \nSince 2013\, Dr. Strzelecki has been part of Mecklenburg County’s Criminal Justice Services (CJS)\, where he serves as the Clinical Director of the Forensic Evaluations Unit (FEU).  In this role he oversees the completion of Mecklenburg County court-ordered forensic psychological evaluations from all levels of the judiciary\, as well as behavioral health diversion programs and grant-based projects designed to address the needs of justice involved individuals with severe mental health disorders\, substance use issues\, and intellectual-developmental disabilities. \nProjects in which Dr. Strzelecki is involved include; Understanding the Frequent Utilizer Population research project with Policy Research Associates\, SOAR-Criminal Justice grant project through SAMHSA to expedite access to disability benefits for individuals that are experiencing homelessness and involved with the criminal justice system\, and SAMHSA’s GAINS Center-Learning Collaborative: Competence to Stand Trial/Competence Restoration project with the North Carolina Department of Health and Human Services. \nWithin Mecklenburg County\, Dr. Strzelecki serves as the chair for the Stepping Up Committee\, which is part of a state and national initiative that focuses on reducing the number of individuals with mental illness in jails. DESCRIPTION:Please join School of Government faculty members Timothy Heinle and Meredith Smith as they host two webinars in December that will highlight changes to adult guardianship proceedings resulting from Session Law 2023-124.  \nPlease see below for specific details about the webinars and to register for each. \nDecember 7\, 2023: Practical Considerations for Implementing Session Law 2023-124 and the Notice of Rights for Respondents and Wards \nSession Law 2023-124 creates the new G.S. 35A-1117 which entitles respondents and wards to notice of nearly twenty enumerated rights. With this notice of rights comes new responsibilities for guardian ad litems\, clerks of superior court\, and petitioners. In this webinar\, we will anticipate challenges and consider solutions to satisfy the requirements and purpose of the law. Please view the webinar course page for more information and to register for the session on December 7. \nDecember 14\, 2023: Meaningful Consideration of Less Restrictive Alternatives to Guardianship under Session Law 2023-124 \nRecent changes to North Carolina’s guardianship laws make clear that an adult or emancipated minor does not lack capacity (and is therefore not incompetent) if a less restrictive alternative to guardianship enables them to manage their affairs and make and communicate important decisions about themselves and their property. This webinar will discuss these recent changes\, identify examples of less restrictive alternatives\, facilitate participant generated ideas for implementing these alternatives\, identify open questions and anticipated challenges\, and highlight how these changes impact the duties of clerks and guardian ad litem attorneys. DESCRIPTION:Please join School of Government faculty members Timothy Heinle and Meredith Smith as they host two webinars in December that will highlight changes to adult guardianship proceedings resulting from Session Law 2023-124.  \nPlease see below for specific details about the webinars and to register for each. \nDecember 7\, 2023: Practical Considerations for Implementing Session Law 2023-124 and the Notice of Rights for Respondents and Wards \nSession Law 2023-124 creates the new G.S. 35A-1117 which entitles respondents and wards to notice of nearly twenty enumerated rights. With this notice of rights comes new responsibilities for guardian ad litems\, clerks of superior court\, and petitioners. In this webinar\, we will anticipate challenges and consider solutions to satisfy the requirements and purpose of the law. Please view the webinar course page for more information and to register for the session on December 7. \nDecember 14\, 2023: Meaningful Consideration of Less Restrictive Alternatives to Guardianship under Session Law 2023-124 \nRecent changes to North Carolina’s guardianship laws make clear that an adult or emancipated minor does not lack capacity (and is therefore not incompetent) if a less restrictive alternative to guardianship enables them to manage their affairs and make and communicate important decisions about themselves and their property. This webinar will discuss these recent changes\, identify examples of less restrictive alternatives\, facilitate participant generated ideas for implementing these alternatives\, identify open questions and anticipated challenges\, and highlight how these changes impact the duties of clerks and guardian ad litem attorneys. She has worked in victim services since the 1990s at a domestic violence agency\, rape crisis center\, prosecutor’s office\, and police department in Rhode Island\, Arizona\, and North Carolina.
