The conference will offer approximately 13.75 hours of attorney CLE credit and qualifies for NC State Bar criminal law specialization credit\, including two ethics hours\, one technology hour\, and one substance abuse/mental health hour. This year’s conference will be held in person May 10-12\, 2023\, at the Winston-Salem Benton Convention Center (301 W 5th St\, Winston-Salem\, NC 27101). \nThis year’s conference topics include emerging issues in Fourth Amendment law\, expert witnesses\, capacity\, motions for appropriate relief\, Second Amendment challenges\, DNA\, sex offender evaluations\, probation\, and more. Stay tuned for the final agenda! \nParticipants:  \nThe Spring Public Defender Conference is open to public defenders\, public defender investigators\, private investigators\, appellate defenders\, capital defenders\, special counsel\, IDS legal staff\, and attorneys from the Center for Death Penalty Litigation (CDPL) and North Carolina Prisoner Legal Services\, Inc. (PLS). \nThis year’s conference will not include a separate track for investigators; however\, investigators may find the sessions to be helpful to their work and are welcome to attend. Please stay tuned for future announcements about new online resources for investigators being developed by the Public Defense Education group and our partners. \nRegistration and Fees:  \nTo register and to find other program information\, including our cancellation and refund policy\, click here to visit the course page. Pre-registration is required. \nThe registration fee for IDS employees—public defenders\, public defender investigators\, appellate defenders\, capital defenders\, special counsel\, and IDS legal staff—is $90. \nThe registration fee for attorneys from the Center for Death Penalty Litigation (CDPL) and North Carolina Prisoner Legal Services\, Inc. (PLS) is $415. Due to space constraints\, we cannot accommodate private attorneys at this conference. \nThe registration fee for non-IDS investigators—federal public defender investigators\, private investigators\, and CDPL and PLS investigators—is $325. \nThe registration deadline is 5:00 p.m. on April 26. There is no on-site registration. \n= \nHotel Information:\nHotel accommodations are available at the Winston-Salem Marriott Downtown (425 North Cherry Street\, Winston-Salem\, NC 27101). Rooms are available from May 9 – May 11 at a rate of $149 plus tax per night. Check out is Friday\, May 12.  Please note that limited rooms are available for May 9. \nTo make a hotel reservation\, you must call central reservations at 1-800-228-9290. Please note that the hotel does not have an online link to book the group rate at this time. Once you reach a reservation associate\, provide them with group code USG. The group rate is available until April 17. After this date\, accommodations depend on availability\, and the room rate is subject to increase. You may cancel your reservation for no charge before 11:59 PM local hotel time two days before your arrival date. \nThe hotel only offers valet parking at $25 a day. Please see the attached parking map for additional parking options near the convention center and hotel.\n= \nTravel and Reimbursement (State Employees Only): Your eligibility for travel reimbursement at the state rate is contingent on state rules and regulations.  Please review the customized travel expense allowance sheet\, as well as the mileage chart from county seats to Winston-Salem.  As an IDS employee\, your lodging is reimbursable at the state rate for Wednesday and Thursday nights if you must drive more than 35 miles to the conference from your home or office\, whichever is closer. Lodging is not reimbursable for Tuesday night unless you drive more than 185 miles. Breakfast will be provided at no charge on Thursday and Friday; state employees may not claim reimbursement for breakfast. \nThe mileage reimbursement rate is $0.625 per mile for those participants with overnight status who carpool to and from the program. (Those who are not eligible to stay overnight are not required to carpool and will be reimbursed at $0.625 per mile.) If carpool passenger names are not provided\, or if you choose to drive alone\, you will receive $0.33 per mile. All exceptions to the carpool policy must be pre-approved by IDS CFO Aaron Gallagher: Aaron.M.Gallagher@nccourts.org. He has practiced criminal defense law for over 40 years\, participated as lead counsel in numerous capital murder trials\, is a recipient of the prestigious J. DESCRIPTION:FREE WEBINAR – June 29\, 2023\, 12:30 pm \n60 minutes of CLE credit offered \n  \n\n\nIntroduction to Adverse Childhood Experiences and Secondary Traumatic Stress: Childhood experiences impact overall development and functioning\, resulting in risk and protective factors. This presentation will focus on the impact of adverse childhood experiences and their impact on brain development and overall health risk factors. Attorneys will gain knowledge on the impact on client relationships and stressors with a focus on improving overall client/attorney relationships and outcomes. \nForensics 101: Litigating challenges related complex scientific evidence can be difficult and time-consuming for attorneys who are not scientists and are dealing with a multitude of other issues in their cases. This presentation will assist attorneys who are new to practicing in North Carolina with effectively evaluating and making challenges to unreliable scientific evidence. Attorneys will learn about how forensic evidence is tested in NC and some of the types of scientific evidence that are ripe for challenge. DESCRIPTION:We are pleased to announce that the 2023 Higher-Level Felony Defense Training\, cosponsored by the School of Government and the Office of Indigent Defense Services\, will take place on September 12-14\, 2023\, at the School of Government.  \nLINK TO AGENDA \nPARTICIPANTS: This program is for attorneys interested in handling higher-level felony cases at the trial level. Topics will include preparing for serious felony cases\, eyewitness identifications\, habitual felons\, self-defense\, client relations and rapport\, sentencing law and advocacy\, and mitigation investigation. The program consists of a mix of lectures and intensive small-group workshops. Due to the program’s interactive nature\, participants must attend all sessions. \nAGENDA AND REGISTRATION: The agenda is posted on the course page linked below. DESCRIPTION:Indigent Defense Services in collaboration with Alliance Health\nAdult Mental Health First Aid\nFriday\, October 6th\, 9:00 am-2:30pm via Zoom \n*Approximately 2 hours out-of-training curriculum must be completed 48 hours prior to live date* \n*This course is limited to 30 participants* \nSchedule:  9:00am-2:30pm (Live\, virtual Zoom) \nAdult Mental Health First Aid: Adult Mental Health First Aid teaches people how to recognize signs of mental health or substance use challenges in adults ages 18 and older\, how to offer and provide initial help\, and how to guide a person toward appropriate care if necessary. Topics covered include anxiety\, depression\, psychosis\, and addictions. ​ \nThis training will provide attorneys and indigent defense staff with valuable knowledge to recognize when a client’s capacity to make adequately considered decisions in connection with representation is diminished due to a mental health crises or substance use. Steps to take to preserve the attorney-client relationship and attorney-client communication will be covered. The program will also cover actions necessary to preserve the client’s or another’s safety\, in accordance with the NC Rules of Professional Conduct. \nThis virtual learning experience includes two hours of self-paced learning followed by four hours of virtual live instruction. The pre-work must be completed 48 hours before the class begins to be granted access to the course by MHFA USA. \nPresenter:\nJames Osborn is a Licensed Psychologist and Licensed Clinical Addiction Specialist with over 30 years of experience. He has worked in a wide variety of settings in various roles – inpatient\, outpatient\, crisis and assessment\, vocational rehabilitation\, and administration. He is the Director of Community Education and Outreach with Alliance Health\, the local management entity and management care organization (LME/MCO) for Cumberland\, Durham\, Johnston\, Mecklenburg\, Orange\, and Wake County. DESCRIPTION:FREE WEBINAR: Friday\, October 27th at 2:30 p.m. \n60 minutes of MH Credit Offered \nSecondary Traumatic Stress: Its Impacts & Strategies for Coping Effectively: Frequent exposure to traumatic experiences impacts our overall health and well-being. This presentation will focus on describing secondary traumatic stress and how it impacts the brain\, who is at risk for experiencing secondary traumatic stress and signs of secondary traumatic stress. Attorneys will gain knowledge on how exposure to trauma and secondary traumatic events impacts overall well-being and how to apply strategies to increase overall physical\, emotional\, and psychological well-being with a focus on decreasing the risk and impact of secondary traumatic stress. \n— \nParticipants: This webinar is open to public defenders\, private attorneys who do indigent criminal defense work\, and their staff. \nSchedule:  The webinar will be held on Friday\, October 27th from 2:30 p.m. – 4:00 p.m. Please plan to sign on 15 minutes before the start of the webinar to test your connection. \nRegistration: Please register at the following link: https://nccourts.webex.com/weblink/register/rab3245c1984183312127f6d3c15710a0 \nFee: There is no registration fee for participants. To receive CLE credit\, all participants must pre-register individually. \nPresenter:  \nCarla Huff\, MEd\, MSW\, LCSW: Carla began her career in the United States Army and was trained in military intelligence and law enforcement. After leaving the military\, Carla worked as a juvenile court counselor for the Department of Juvenile Justice & Delinquency Prevention in Wake County (Department of Public Safety-Juvenile Services). Carla also spent time working in Wake County Public Schools\, providing support for children and adolescents diagnosed with Severe and Persistent Mental Illness (SPMI). She later transitioned to working with Alliance Health\, a local managed care organization. SUMMARY:2023 Misdemeanor Defender Training
DESCRIPTION:Registration for the 2023 Misdemeanor Defender Training\, cosponsored by the School of Government and the Office of Indigent Defense Services\, is now available at https://www.sog.unc.edu/courses/misdemeanor-defender-training. \nProgram: This course is an introductory program for attorneys new to misdemeanor cases. Sessions focus on stops and searches\, impaired driving\, ethical issues in district court\, sentencing and jail credit\, probation violations\, and other matters in misdemeanor cases. The program also provides instruction on client interviewing\, negotiation\, and trial skills\, including a small group workshop on trial skills. \nParticipants: This training is for public defenders\, contract attorneys\, and private attorneys who perform a significant amount of appointed work in district court. \nLocation\, Dates\, and Times: The agenda will be posted to the course page soon. This training will be held from Tuesday\, November 14th through Friday\, November 17th. \nRegistration: To register and find other program information\, including our cancellation and refund policy\, visit https://www.sog.unc.edu/courses/misdemeanor-defender-training. \nThe registration deadline is 5:00 p.m. on Monday\, October 30th. If you register\, please plan on attending all sessions. \nNote that you must create a new account when registering for the first time in the system.
