97.30 Visitation

In re T.S.A. and D.S.G., COA04-1057, David Childers for appellant-father.
Court erred in failing to issue findings of fact or conclusions of law regarding father's visits after custody awarded to maternal relative when father had previously been awarded visitation.
Slip Opinion

In re E.C., COA05-218, Rick Croutharmel for appellant-mother.
The trial court's dispositional order failed to include an appropriate visitation plan in that the trial court ordered visitation between respondent and her child to be in the "discretion of the guardian." The awarding of visitation of a child is an exercise of a judicial function, and a trial court may not delegate this function to the custodian of a child.
Slip Opinion

In re K.S., COA06-1697, Richard Croutharmel for appellant-mother.
Oral order ceased visitation; written order ordered it "according to schedule"; and, no findings made that continued visitation would be contrary to the child's best interests.
Slip Opinion

In Re B.L., J.L., J.H., and H.G., COA07-598, Duncan McCormick
The trial court erred in failing to establish an appropriate visitation plan.
