Termination of Parental Rights
82.10.e Grounds for Termination-Child Support with Prior Decree 7B-1111(a)(4)
In
Re A.S.W., COA06-708, Duncan McCormick for appellant-mother
The prior consent order required the mother to reimburse Petitioner-father for
one- half of the minor child's uninsured medical and extracurricular expenses
yet the petitioner did not present any bills for at least nine of the months
next preceding the filing of the petition. The mother's failure to reimburse
was not willful in light of her limited ability to pay support and the petitioner's
failure to request any reimbursement.

Re A.A.R., COA 07-280, Lisa Lefler for appellant-father
Since the trial court failed to make a finding of fact based on the evidence
that the father's non-payment of child support was without justification, the
trial court's conclusion of law is not supported.

Re C.M.R., et al., COA09-117, Mercedes Chut for appellant-father
The trial court erred when it failed to consider evidence that the father's
failure to pay child support was not willful.
