Termination of Parental Rights

82.10.a Grounds for Termination-Abuse 7B-1111(a)(1)

In Re L.G., COA04-456, Sofie Hosford for appellant-mother
The trial court erred in finding that the child was abused instead of finding that one of the parents abused the child as a basis to terminate parental rights.
(COA linked incorrect opinion to this case )

In Re D.L.W., COA06-1715, Winifred Dillon for appellant-mother
Because the trial court's findings do not show that Respondent caused the harm to her son, or that she would likely abuse him if he were returned to her care, the court erred in terminating the mother's parental rights on this ground.
COA Opinion

In Re R.B.B., COA07-727, Annick Lenoir Peek for appellant-mother
The district court's findings of facts do not support a conclusion that grounds exist to terminate Ms. Childress' parental rights due to committing a felony assault that results in serious bodily injury to the child as the petitioner failed to prove the elements of the offense and Ms. Childress has not been convicted of such a crime.
COA Opinion

In Re H.R.S., R.F.S., COA09-1115, Anna Lucas for appellant-mother
The trial court erred in terminating on the basis of neglect/abuse because the probability of repetition should not have been found where the mother had 3 other children in her care with no incidents.
