The trial court erred in denying the respondent-appellants' motion for funds to employ an expert witness and to take a telephone deposition of an important witness in that the indigent respondent has a right to prepare his or her case.

The TPR proceeding was commenced by a counterclaim filed in response to a complaint for child visitation in a civil action. The trial court abused its discretion by granting the petitioner's motion to amend her answer and counterclaim 8-1/2 months after the original answer and counterclaim was filed.
